Perhaps they sent her letter after letter and she didn't respond or communicate? She admitted she was "distracted" and didn't tell them anything. For years she was too distracted to say anything?

I'm sorry, but not paying something for multiple years and not telling them why or what your plans are makes you at fault.

Don't disagree but when you aren't getting any response from the letters, you may want to try a different strategy or approach. In the end, it's still moronic but this is the world we live in.

I had a client several years ago who is an NRA (foreign person) who bought a Miami condo to rent. Dude hasn't been to the US in years, just gets mailed about 100k in rental income per year (condo is a few million).

Anyway, long story short, Miami Dade had an incorrect address for him. He paid the HOA dues every year, but property taxes were not part of the dues. One day he gets a notice from the HOA that his condo was scheduled to be auctioned off the NEXT DAY. Dude is in a different time zone in Asia. I get to work (law firm) at 9am and have panicked voicemails from him and call him. Its midnight his time and we try and figure out how to get a 100k wire to us in our escrow account to pay the bill as it is now the next day and the condo was set to be sold at 1pm.

It was impossible. Zero way to get the 100k wired out at midnight in Asia to post within hours for us to pay.

I mean, legally, the HOA can foreclose after 9 months of missed payments. It sounds like this went on quite a bit longer than that.

Reading the policies of the HOA makes it clear there are quite a few steps, including multiple certified letters, that are taken before foreclosure and a sheriff sale is initiated.

Oh, I should add it worked out. The guy knew someone in Miami and arranged for him to make the payment for him so he kept the condo. Barely though and only because he had a friend or someone that was willing and able to do that.

Right.

People are going to overreact and blame the HOA immediately here and call them evil. This lady is completely responsible for this house going to auction.

They probably should've set the minimum auction price much higher.

I certainly can sympathize with this woman for her medical issues and family members dying, but it sounds like not only did she just stop paying her mortgage/HOA dues, she made no attempts to communicate or try to talk with these companies to come to a resolution. This one's on her, unfortunately.



Also, how the shite does a $500k sell for $30k in a mortgage? I'm most interested in how the hell that happens.

They sent her several certified letters that require signature.

She knew she wasn't paying for years and knew their intentions, and she didn't communicate hers.

I’m keeping a list of everyone who badmouths hoas in this thread so I can know not to let them in my neighborhood
