Yep, known of similar circumstances where lenders were like the "Nope, nope, nope" gif. The lender would rather take the single loan hit than the negative press over putting some elderly sick person on the streets. (of course they'd swoop in the day after the owner passed away, provided no surviving spouse to call local TV)

Appraisers would just ignore this price of this home at auction.
And while this law is absurd, this lady should shoulder all of the blame. She was a squatter for years and didn't communicate to anyone at the HOA that she was selling.
This wasn't a few missed HOA payments and her begging for some time. This was years of non-payment and her not saying shite to anyone.

HOAs are many times necessary to keep nice neighborhoods in order and prevent trashiness. The problem is that a lot of people serving on HOA boards power trip because they little dicks or little worth outside of that board. People who actually have stuff going for them in the real world don’t act like clowns on their HOA, or make a big deal out of lowering the neighborhood speed limit by 5 mph.

I never got the hate for HOAs until my neighbor had to take down his $3000 playlet for his daughter because he didnt get proper approval to put it up.
Another neighbor complained that it was against the covenants to have one "so high" and he felt threatened when the 6 year old girl was at the top of it - it was similar to this:
The HOA sent someone out to measure, and it was inches higher than the covenants allowed for without a variance approval. They made him take it down and would not approve a variance based on neighbor objection.
I knew the HOA president and I tried to reason with him and he blew his friendship with me over this.
Another friend in our neighborhood was accidentally late on his semi annual dues - just forgot to send the check. Within 30 days they had assessed 75% in in late fees and put a lien on his $400k home.
I LOATHE OUR HOA.

I realize situations change and the unthinkable can happen but why are you not upset with the woman for not downsizing instead of essentially squatting

Why wouldn't they sell it for market value and then the HOA gets the first $30K of proceeds because they had the priority position? I don't get that?

The mortgage lender was the real screw up in this situation. How do you let a home with a $300k+ mortgage get bought for $30k? Nevada law requires HOAs to notify junior lien holders of a foreclosure, so the lender knew this was about to happen. The vast majority of the time the lender pays the dues to prevent their secondary lien from becoming worthless.

I agree that the law is crazy though.
She was trying to downsize. Did you not read that she had negotiated with her lender for a short sale so she could get out?

I don't care what happened in your life, it doesn't excuse multiple YEARS of non-payment and non-communication. A few months? I get it and the HOA probably would have as well. This was not that.

Time to start going to the meetings and bring as many home owners on your side. You can easily vote out the current board and with a new board, write new bylaws.

Very few things are morally justified that an HOA does even if they have legal right to do it. Just because they can sell the house out from under someone doesn't mean they should do it. That is absurd on every level.
Again, I don't disagree that they have the law on their side but no HOA should ever do that to anyone. It's bullshite.
