Exactly. And boot her from the house and deal with whatever mess she leaves behind. So the guy might make $100k here, but he's going to have $300k tied up in multiple PITA nasty legal battles. Dealing with a foreclosure department and a lady that had her house taken from her is a PITA.
Let me also say, that I'm guessing the HOA moved forward because the bank was stalling. Everyone is saying why didn't the bank move forward first? Well they'll likely get their cut no matter what. But the damn banks with these foreclosures, they only want so many foreclosures at a time. I've seen banks let people sit for years and years. So the HOA said screw it and moved forward on their own.
On a final note, I'd bet the HOA racked up $20k in legal fees here. Maybe more, which will have to be paid out by the buyer additionally.
As a past HOA board member, I'll tell you the biggest PITA was owners that were lawyers. Because they'd threaten BS all the time as their time was free and the HOA had to pay. So they'd threaten BS that would cost the HOA more than the owner owed in legal fees routinely.

Kinda right.
There are plenty of examples of HOA superpriority liens extinguishing primary mortgage liens.
However, it doesn't mean the bank won't take the matter to court.

Correct and FHA as well. Soooooooo I would assume that this was a sub prime loan where nothing is escrowed. My guess is that she was uninsured and on top of that probably delinquent on property taxes as well. It was a matter of time for this lady.
