What were the relative speeds at the time of collision? The plane almost had to be going faster, how many seconds was the plane in the line of sight of the boat?

Negligible arguement... which craft is more maneuverable?? The plane or the boat??... the answer is the boat. Speed is only one factor in maneuverability... the boat is more agile and more maneuverable... the boat crossed the path of the plane

Examine the extreme version.. who is at fault? The jet ski or the ocean liner? While that is the extreme version of the exact same question, it also points to the exact same conditions presented here... this is 100% boats fault

The plane. It took off in an established seaplane runway if you will. The boater fricked up and got charged with a BWI

In the pecking order of boats a sea plane has the least priority. Seems like arse backwards logic, but that’s what I was taught while I was in captains school to get my 6 pack license.

What boaters know about seaplane landing strips?

I have a boat, and a seaplane license. I’m on both sides of this one. It looks like the boat was hit from behind. He probably never saw the plane and I’m sure he didn’t have a sectional that showed him where the seaplanes operate.

When I am operating on the water in my amphib, my rule is that my toy costs more, therefore if there is a chance of collision, I wait until there isn’t a chance. A pilot operating something like a beaver (the holy grail of seaplanes) should have taken better care. Not saying that as a legal stance, but as the current owner of such a plane, he owes it to those before and those that would have come after to be a better steward of that magnificent airplane.

Typically areas for those types of planes are marked by buoys for landing/takeoff so I’ll assume plane had right of way

Frankly they both look guilty here. I don’t see how you allow that to happen with the video in the OP as there’s plenty of vis, the boats going a relatively slow speed it’s not like it shot in out of nowhere to the point the boat should have seen the plane and the plane should have seen the boat.

ETA: so watching the video again it looks like the boat was heading toward the sea plane initially at a mostly parallel course, then likely veered off into the path of the sea plane for quite some time before the collision occurs.

Right of way or not, I’m just gonna get out of the way of the plane and let it take off.

Sometimes, people’s egos get them in bad situations. Be mad but not hurt. Just get out of the way of the plane and then go about your business

You don’t have to have the aeronautical sectional to know that info. The seaplane ops area is also noted in the Vancouver Harbor marine navigation charts.

Boater didn’t do his research.

With the pilot sitting left seat (if it was SRM) would’ve been unable to see the boat crossing right to left.

Those seaplanes tend to nose up when on takeoff roll due to the drag created by the floats in the water. Once it gets enough speed, and the floats get on top of the water, the nose will naturally lower.

Think of a boat accelerating quickly in the water. Same concept.

Plus, the boat was in restricted waters due to seaplane activity.

This is the part I was going to mention.

If the plane or the boat wasn't supposed to be in the area to start with, then I would assume the other that could be in the area would have the right of way.
