you should have shot his arse while he was in your yard the first and second times. now, it would look like you're the aggressor if you took action when it wasn't on your property. i'd call the police and have a candid conversation with an officer about what your options are and go from there.

have you had a serious conversation with your neighbor? i'd start there if you haven't, and enumerate each close encounter and his liability in the matter. if you have well documented evidence, which it seems you do, then i'd tell neighbor that unless he wants a suit slapped on him, he needs to get rid of or house his dog.

I was in a similar situation recently except someone must have dropped the pit bull off along the highway and it made its way into my subdivision. The dog was super aggressive with everyone it came in contact with. We called animal control and they wouldn't come get it.

This is where the story ends for legal reasons.

Their answer was they didn't have an animal control guy at the moment, but sure as shite did see one a week later picking up another stray.

Our neighbors have a pit mix dog and she is mean. My husband has let it be known if that dog comes after any of us in this house, especially the baby, then it will be a dead dog.

Where do you live?

In most places not "out in the country", dogs cannot just be out running around. Most places have leash laws and fences.

If it gets on your property again, SHOOT IT.

Shoot it if it comes in your yard again. I would want nothing to do with a pitbull anywhere near a 3 year old child.

I would think the city would be quick to do something about the dog once there is a paper trail documenting how dangerous the dog is. You would think the city would be on the hook for shitloads of money if they didn't do anything and God forbid something happened afterwards.
