The force below is non-deadly, but to prove justification of immediate deadly force you have to prove self-defense with non-deadly force was justified and then move on to proving elements of justification of deadly force.
quote:46.02 includes location restricted knives which are 5 1/2 inches or longer being restricted to carry or have at certain locations including school properties and sporting events.
(b) The use of force against another is not justified:
…(5) if the actor sought an explanation from or discussion with the other person concerning the actor's differences with the other person while the actor was:
(A) carrying a weapon in violation of Section 46.02; or
(B) possessing or transporting a weapon in violation of Section 46.05.
Big issue is that removing the restrictions/limits does not prove force of any type was justified. It removes items that would black ball self-defense from the start.

I get that, but in doing so they aren't helping him. You can argue the weapon was legal to carry and only violated school district policy,. However, you are showing a negative pattern of behavior and a disregard of weapons policy because he was in the middle of being punished for previously being caught with a knife on school property.. The other problem is that the use of force must be proportional. Up until the very last second you have what boils down to two people arguing. One is making a reasonable demand that he leave the teams tent area, and the other is covertly unfolding and arming himself with a knife daring him to touch him and find out. A verbal disagreement is not an immediate threat and Texas law prohibits the use of deadly force in such cases, and yet KA armed himself and was prepared to killl and did kill

I’m not sure any of these defense witnesses are doing them much good.
At BEST they have established that the knife was legal.
At worst, they have repeatedly established that he was told to leave and didn’t, that he wasn’t surrounded, etc.

What I mean is that having the knife, under Texas law, may not have automatically destroyed his self defense claim.
Too bad for him that his “touch me and find out” shite and Metcalf not starting a fight still destroys that.
