I ain't losing sleep that a thief is dead... but once he left the property, there was no longer an imminent threat. Dude is screwed.

If someone steals something over a certain value it should be completely legal for the owner to kill that person. It should be pretty simple, if someone does steal something of value then they are willing to risk their life to steal it.

this doesn't seem like it should be a crime on it's face, but the issue is you can't legally have people just shooting at a moving vehicle in the middle of the streets. if he misses and hits an innocent bystander then shite is even worse. I understand that he didn't, but laws are made for everyone. If this guy is allowed to legally shoot in traffic chasing a stolen vehicle, then someone else with much worse aim would be allowed to do the same.
hopefully the judge uses the fact he didn't hit anyone else to give him the lightest sentence possible for discharging a firearm in public. he shouldnt be charged with murder though, the dude stole his car.

Couple of things:
The perps buddy was in on a crime that lead to a death. There are some laws that tar and feather the guys who are there for the crime with serious offenses.
Harris County, you say? How in the heck are they going to find a jury where no one they know or are related to has been affected by vehicle theft? Or will it be a jury of family and friends of other car theft perps? How do you decide jury composition in any urban area?

Felony Discharge of a Firearm From a Vehicle
It is a second-degree felony to knowingly and willfully discharge a firearm from a vehicle within 1,000 feet of any person. The driver of the vehicle, if the driver is not the person who discharged the firearm from within the vehicle, can also be charged with a felony in the third degree if he knowingly directs any person to discharge any firearm from the vehicle.
