Supreme Court (of LA) says judge age restriction is still good law

Interesting decision and it will affect the makeup and power within the 19th.

In a ruling released hours before qualifying for elections began Wednesday, the Louisiana Supreme Court shot down two judges' requests to do away with a mandatory retirement rule for all judges that prohibits them from seeking re-election after they turn 70.
Both Baton Rouge District Judge Janice Clark and New Orleans Magistrate Judge Harry Cantrell challenged the age requirements in separate lawsuits with Clark, 73, and Cantrell, 72, both looking to pursue another term on the bench. Up until now, judges have been allowed to stay on the bench if they turn 70 during one of their terms, but cannot not run for another term after turning 70.

Janice Clark hasn't been competent to serve in that capacity for some time now (if she ever was in the first place), I can't imagine it's getting better with age.

When was this law originally passed? 70 is not what it was 50 years ago.

She is a legit lunatic. I would say she was an embarrassment to the Louisiana judiciary, but most of them are scumbags anyway

Good. Older judges are so jaded and can be so challenging to appear in front of. Plus they are less enthusiastic about working and often don’t read the parties pleadings

A few years ago. Voters actually approved it as a constitutional amendment.
Then they tried to reverse it in 2014 by constitutional amendment, but the voters defeated that.

Well she was certainly not the person you wanted challenging this law. I think she has to hold a record for being overturned. But you do wonder about the age discrimination aspect of it. In practice the louisiana SC appoints retired as hoc judges to handle lots of stuff and they are over 70 a lot of times.

That she is the worst judge in Louisiana doesn't seem to be related to any lack of competence due to age. She's been that bad for the last 25 years at least.

Not sure. Some may think they still have something to offer, while some may still want the power. But there are no limits on federal judges and you have one still hanging on in the nation's top court at age 87.

I know an attorney who filled an exception of prescription and Clark not only ruled against her but ruled on the merits of the case against her.

If the voting electorate of the state thinks this is the case, and thinks the age should be raised, there is a vehicle to rectify it. It is not the Louisiana Supreme Court.
