Smith was off duty, it doesn't matter either way. Smith is trained to de-escalate situations before violence erupts. He did the exact opposite by beating Couvillion's arse in a public setting in front of many eye witnesses. Hence, Smith will be arrested within a week.

I am just saying that the obvious conclusion to his behavior of being a nonstop antagonizing douchebag is to get punched in the mouth.

Yes, it would have been better if it wasn't the sheriff doing it.

I have no idea what the law says? What does it say? Does him/police officer getting assaulted off duty carry stiffer penalties than for civilians? I’m asking. You tell me.

That’s my point. Assault is assault regardless of who was a cop and who wasn’t. The Sheriff should be arrested like anyone else and treated the same way. He assaulted the guy and should be treated accordingly.

I keep wondering if Smith had a pistol. While I suppose we will never know, and not knowing anything about him personally, for some reason I get the impression he would be the type to be in a bar drinking and carrying. Things might have gotten real very quickly if he had been arrested on site and a pistol had been on his person.

either there is probable cause to charge Randy Smith with assault or there isn’t. There is the account of the accuser, there are eyewitnesses on the record, there is video from the security cameras.

Statements or posts or accusations made by the victim prior to the incident are irrelevant to the evidence of what happened on Friday. Any “he had it coming” defense would be addressed at trial.

We either have a set of laws that apply to everyone or we don’t. What is taking so long?
