Nope. Even if the shooter did something to instigate, we are talking about two different altercations at that point. The shooter pulls into a parking spot and the guy follows him. There's no question that the first two shots are 100% justified.

This is 100% accurate whether you agree with it or not.

First shot = ok

Subsequent shots will get you convicted.

You don't stop and analyze each shot when in a situation like that. Sure the last shot appears to be in the back of the head but I would have unloaded all 6 shots.

Exactly. In this situation you keep firing at them so long as they're still upright. The last thing you want to do is shoot them once then stand back and see how they react. They may react by tapping you on the side of the head with that baseball bat. No, you keep firing until the threat they pose is completely neutralized. Which that's what this guy did from what I can see.

Was the bat guy on drugs? Is there a possibility that bat man was on drugs? The guy was not rational, you don;t know if the threat has been eliminated. Bullets do not always hit where you aim. People do not die like in the movies. It isn't like the shooter walk backed 3 minutes later after he had been laying on the ground and shoot him again, completely justified.

I agree there are two altercation points in this scenario; I'm just saying that guy would be leaving his fate up to a jury (i.e. Trayvon Martin case study). I'd rather not leave the "who instigated this" up to a jury.
