Look at it from the bat guy's perspective.
I'm about to step out of my vehicle and go after someone with a metal pipe because they didn't use their turn signal. He may be armed, so I probably shouldn't do it. If he isn't armed and I decide to swing at him, then what? Best case I go to jail for assault. Worst case, I kill the guy and I go to prison for life.
Maybe I should move on and still be alive.
*edit
I understand your point, so don't take it personal.

You never know who exactly you are messing with.
Could have been some dude that's done wet work in the Middle East for 15 years.
That's why you don't go messing with people

Just took a concealed carry class. I'm interested in what led this this altercation. If the shooter did something to instigate this; it's not good on him.
Nope. Even if the shooter did something to instigate, we are talking about two different altercations at that point. The shooter pulls into a parking spot and the guy follows him. There's no question that the first two shots are 100% justified.

Manslaughter
Once the threat is neautralized, dude down on the ground, you need to stop shooting
Unless they can prove the first shot killed him or something
This is 100% accurate whether you agree with it or not.
First shot = ok
Subsequent shots will get you convicted.

clearly self defense no question
case closed
You don't stop and analyze each shot when in a situation like that. Sure the last shot appears to be in the back of the head but I would have unloaded all 6 shots.

when you mean 100% accurate, i'm assuming you meant like a weather forecast.

there is absolutely no way to argue the kill shot was necessary

I see a man defending himself from a psycho with a bat trying to inflict serious harm.
He's walking IMO.

life threatening situation, you are not thinking... self preservation kicks in, you shoot till you feel safe...
guy with bat is the instigator...he even opens car door going after him...
Exactly. In this situation you keep firing at them so long as they're still upright. The last thing you want to do is shoot them once then stand back and see how they react. They may react by tapping you on the side of the head with that baseball bat. No, you keep firing until the threat they pose is completely neutralized. Which that's what this guy did from what I can see.

Completely incorrect.

There's also no need to argue that.

Was the bat guy on drugs? Is there a possibility that bat man was on drugs? The guy was not rational, you don;t know if the threat has been eliminated. Bullets do not always hit where you aim. People do not die like in the movies. It isn't like the shooter walk backed 3 minutes later after he had been laying on the ground and shoot him again, completely justified.

Exactly how I see it 7thWard. There was absolutely no need to execute that dude , leaned over for the kill shot to back of the head. The threat was neutralized, you have the bigger weapon, step back after first two shots & guy is slumped over & making zero threatening gestures. I get it, "don't start nothing, won't be nothing." But that just seemed extreme.
That's a great way to get yourself killed.

Looked justified to me, that's the risk you take now days road ragging on someone.
If homeboy would have hit him with that stick he would have been F'ed up

I agree there are two altercation points in this scenario; I'm just saying that guy would be leaving his fate up to a jury (i.e. Trayvon Martin case study). I'd rather not leave the "who instigated this" up to a jury.
