The tenant is a scumbag in this situation but I don’t understand why the landlord has to live in his car. Does he not own the house still? What’s making him sleep in the van?

Lease agreements tend to limit a landlord’s presence within the leased property to announced maintenance.

A signed lease. You can't move into your rentals just because you feel like it if they are leased.

He has to go through the eviction process. Taking a year to complete an eviction in Seattle is the biggest issue here that allows stuff like this to happen.

If it didn't take a year, the renter would either already be out or wouldn't feel so emboldened to do this sort of stuff. Now that he knows how it works, he will do it to whoever he rents from next.

And shite like this is why landlords do background checks on tenants.

If I ask for a history of where they lived and I came up with someplace that had a squatting case / lengthy eviction process, they are probably getting rejected.

I’d rather the property sit vacant than deal with an a-hole like that because you are losing money anyway but could still potentially put a good tenant in it.

Not buy a house in a liberal area that has a year-long eviction process

If this person was a squatter, I would pay someone else to squat when the person leaves for work or whatever. People are doing that in Cali and it's working.

With this situation involving a lease Jason is F'd. Anything he does could get him sued both criminally and civilly. He's in a no-win situation and has to wait for the legal process to play out.

I would like to say I would risk the civil issue and skirt in the grey area of any criminal issues but Seattle being so progressive would have me doubting any actions, to be honest.

Sell the house to an investor as tenant-occupied maybe. Some investors would buy it and wait for the legal issue to play out.

IIRC in some states, you are only allowed to run a BGC for criminal activity and credit verification. Not previous rental issues.

Who says? Squatters are showing fraudulent leases to cops and then they are telling the homeowners it’s a civil matter. This would actually be a valid lease. Cops will tell the delinquent renter it’s a civil matter then.

Very likely this happens and then the guy is forced to go to court which will take months or years to settle. But he is out of the house. Guy will likely just move on to his next victim.

That renter should be prosecuted for criminal fraud. That’s far beyond just a civil failure to pay rent matter.
