He was, he is out now. Cory Maye.

They served the KNOCK warrant on both sides of a duplex at more or less the same time. Maye was asleep and claims the first thing he heard was them attempting to break in in. He says he never heard them announce. He retreated to his daughter's bedroom and shot the police chief's son as he entered the bedroom first. Maye had no criminal record and even on the "correct" side of the duplex, the other guy didn't have enough weed for them to even bother charging him. So much for the "tip".

Maye was tried and convicted and went to death row. I think he served about 10 years before it got some media traction and his case was remanded for a new trial. Instead of taking his chances he plead to manslaughter and was released on time served.

So there really isn't too much more to the story, someone not subject to the warrant in a different abode from the warrant was sent to death row for killing a cop during a knock warrant. No prior criminal history and no concurrent charges. If it weren't for a nosy journalist he likely would have been put to death.

The reversal was a little more technical than just addressing the facts and done on trial court reversible error based on jury instructions. YOu can read the MS Sup Ct opinion here:

That's good to hear. I didn't know he got out of it.

Last I heard, the Appeals Court rejected his appeal.

How recently was he released? Read an article tonight from 2019 that mentioned the case and it brought up some memories for me.

That instance may be the only time in a cop’s life that he gets to unload on a bad guy. He has to make the most of it o he’ll never forgive himself.

Someone much more advanced in knowledge on this subject will have to explain this to me but why are no knock warrants necessary if you have a place surrounded? Is it evidence the police are trying to preserve? Trying to surprise the felons so that don’t arm up even more ? There have been examples where the police just went to the wrong address and tragedy occurred. These types of warrants seem fraught with possible bad outcomes but again I know little for the reason.

originally they were put in place to save and preserve evidence for the war on drugs.

then they were supposed to be used to arrest the most violent criminals

now they are just how they serve warrents.

and i take offense to the calling of people they serve these warrents on as felons. a felon is someone who has been convicted not someone the police serve a warrent on.

there have been so many cases of the police receivinig false tips, wrong address and other bullshite and tons of people killed or life ruined because of no knock warrents

like a police chase they are actually more dangerous to the officers and to the public as a whole then waiting, keeping the suspect under survellience and then taking him down when the time is right.

bottom fricking line.....any and all that love the constitution, democrat or republican should be screaming from the roof tops for appeal. same with civil forfeiture.

never understood why people supposted these things and sure as hell didnt understand why so many supported trumps position on these things.

these kinds of things lead to (as discussed yesterday) little towns of 1500 people in podunk alabama, louisiana, and the landmass to have swat teams and vehicles. that is not what our police where meant for and it has to end.

it wont under biden as he loves to throw people in jail, especially people with darker skin, but both parties should be making these things huge issues for the 22 candidates. if the dems put hillary forward....well she loves killing some "super-predators" then dems are fricked. hopefully if the R nominee is trump he changes his position on these things.

I saw one of these where the guy had a belt fed weapon set up and when they came, he unleashed it.

I think 3 or 4 took rounds and the officers back out.

The guy ended up coming out peacefully but i was thinking, if you are gonna go down, that’s one hell of a way to go down

I don't like it. Maybe the guy was a criminal, idk?

But no-knock warrants really rub me the wrong way. There is so much room for error. Amazon drivers regularly delivr packages to the wrong address, yet we're supposed to blindly trust that police officers will always get it right?

Not to mention, that looked like an apartment complex. Even if you do get the right house, you're placing all the neighbors lives' at risk.

Any reasonable person will grab their gun for someone busting down their door in the middle of the night. That should not ever be illegal.

I was once in a house in Kenner 4 detectives raided. They had no warrant.

I questioned them. They said kenner passed a law where warrants weren't needed. One person in the house signed a paper and took the charge for the total 1/8 of weed found and one alaprozalam.

do you just assume someone at the door busting it down is a cop just because they yell saying so (which again, how do you even know you could hear what they were saying if he was asleep/just waking up as all the commotion was happening)

and since the warrant wasn’t even for him, in my opinion he had every right to blast away at those banging down his door

oh ok. a bunch of guys were yelling at his door for 7 seconds (at 5am) before breaking down the door. he definitely should have known it was cops.
