If you want to add phantom vehicles to the scenario that's fine, but I was speaking to the specific rule that says the car must yield the right of way to the truck with the dash cam. Your scenario adds speculative occurrences that might or might not have led to another collision

the truck is not driving aggressive. He is coming off of a turn which has a speed limit of 25 mph and trying to get up to speed to merge into an interstate with a posted 55 mph speed limit which in reality that if you arent doing 70+, you will not be able to merge as the two right lanes are exit only about a mile up the road. plus he is being pushed by the other cars behind him who are trying to get up to speed to merge as well. I have no love loss for truck hogging lanes, but he didn't do anything wrong here. He has no responsibility to slow down to let the black car merge.

Car is clearly in front of the truck when the last dashed lines disappear and they are both in a legal single lane, despite its width. Therefore the black car clearly had the right of way when being passed by the 18 wheeler.

Both are dumbasses for not avoiding the accident

It's a fair point, but I would argue that once the individual lanes cease to be separate lanes (when the dividing lines stop), which way you merge should be immaterial, because all the cars at that point are in the same lane.

Unless of course both cars were side by side when the two lanes turned into one. Then the signage from before would determine that the right hand car failed to merge left in time for the two lanes to becomes a single lane.

That's my interpretation of the signage. Obviously they are both idiots for causing an easily avoidable wreck.

Car. Speed the frick up.

I think the red vehicle looks like the highway's merge speed, but that car was probably slowing down for the two trucks to merge onto the highway. Notice how the middle and left lane cars are going much faster than the red car.

It's your responsibility to merge onto the highway.

Car is at fault, the truck has control of that lane. It does not matter if the car was on front of the truck when merging, the car has to yield to the truck.

That is not how this works, it isn't NASCAR.

The truck was in a lane, legally, the cars lane ended. It is his responsibility to safely merge. He did not safely merge.

the truck driver was a dick, but being a dick isn't against the law.

I agree with you on this, but then he fails to maintain a speed which would allow merging safely, which puts him at fault.

By definition, the black car is an idiot as a simple tap on the gas and he's in the hole, no harm, no foul. (except that he's an idiot for getting in that spot to begin with)

That said, once the truck saw he was going to hit him, he should've let him over. He does have a duty to his employer (and just straight-up common sense) to simply avoid a wreck if possible.

If I hit everyone I had a right to, I'd have a wreck a week.

Any good driver will avoid an accident if at all possible.

The trucker decided not to, so I hope his half-witted arse is fired.

The car driver is a quarter-wit, if that makes everyone feel better.

Both of the idiots were probably on their phones.

100% the car's fault. The truck already occupied the LH lane so it was the car's responsibility to either speed up and merge in front of the truck or slow down and merge behind the truck.

There is always a chance that the truck assumed the black car was beginning to merge safely and so the truck began eyeing the red car and left lane for an opportunity to merge.

The car of course. It's his job to merge, the truck is just driving in his Lane. The car should have sped up or slowed down to zipper in.

The merging lane is responsible to give way to the car in the non merging lane. Thats it.

If you are the merging vehicle you should accept 100% of the responsibility to enter the non merging or travel lane as close to the travel speed as possible as safely as possible. You are not entitled to enter the lane because you were going faster than the car in the non merging or travel lane or because you have a Salt Life sticker on your back window.

I don't think so. The truck could've easily slowed down to avoid the wreck, plus there was plenty of shoulder up ahead.

I understand none of this happens if black car drives correctly, but every day each of us faces similar situations.

Trucker either had his head up arse or more likely, was just being a dick.

Bottom line, the wreck was easily avoidable.

They are both at fault. Most fault on the car for failing to speed up. Some fault on the Truck because it had chance to avoid too. IMO opinion, the car gets most of the blame because its driver had his/her head completely up his/her arse.
