The car should of merged earlier. Not the trucks fault that the car is running out of lane.

When they pass the last white line dividing the two lanes, the car is in front of the truck and they are now in the same lane. So I say technically the truck is at fault.

But they are both idiots.

Car could've just sped up. But the truck is definitely in the wrong here. No doubt

I guess it's the car's fault. Had plenty of time to merge left, like the sign says, but didn't. But, the truck could have easily slowed down..

The car should have sped up in front of the truck instead of assuming the truck would move or even not looking before merging.

it would be the cars fault. I have driven that interchange many times coming off of 285 and merging onto 75 south. As you come off of 285 it is two lanes, and one lane is supposed to turn right onto the Riverdale Road and cars proceeding onto the 75 should be in the left lane. I have almost been hit in the same scenario half a dozen time for people who do not turn right and try to cut over to merge onto 75 before the lane runs out. if the truck slows down, he causing an accordion fender bender with the 60 cars behind him trying to merge.

if you look the black car is going faster than the red vehicle in the slow lane of the highway....so technically, and without a reference speed, the black car was already at speed for properly merging with the highway's traffic......the truck is going faster than both with clear vision(and probable intent) to cut off car.

The car played chicken and lost. It's not like a truck is sitting in your blind spot.

The first frame of the video shows that they were two lanes and the right lane ended, merging left. The truck had no obligation to alter course. Car is at fault 100%.

If you look at the speed in the lower right corner, he was not speeding up. He was maintaining his speed and his lane. That's the car's fault. He's the one that had to merge. He should have either sped up more or dropped behind.

The truck stays in his lane. The car has to merge and the truck can't get over (notice the car to his left). I think the car is in the wrong. That being said, the truck could have braked to let him/her in but at the moment of contact. But the truck is still rightfully in his lane and the car hits him so at fault goes to car driver, IMO.

Would like to hear from one of our esteemed lawyers here though.

and if you look at the distance between the blue semi and the black car, the distance is maintained(they are going the same speed, if black car speeds up he's up the semi's arse).....the truck is coming from behind at a rate to overtake the black car.
