the car should have merged except should have done it where he didn't merge in to the truck. Was probably smoking a pot and too high to realize they needed to merge till it was too late

Looks to me this is exactly what the car tried to do.

The car, to me, looks to remain at constant speed and assumed the truck would slow down.

I see this happen all the time on the zipper merge I use going home from work. Zipper merging may require slowing down OR speeding up to fit into your slot. No one understands this.

I blame the "defensive driving" rhetoric they teach people. Euro countries have exponentially better drivers and do not do this.

What people seem to be missing is that you have a duty to avoid an accident and by not doing so you are at fault. An example someone is pulling out of a driveway and pulls a little too far into the street, three or four cars go around him but you decide just to hit the son of a b**** cuz he's in your way and you have the right away. you're at fault

Actually in the bottom right of the video you can see his speed decrease. Minimal, but steal a decrease.

Legally I have no idea but the car driver is a fricking moron for trying to merge. He should have known good and well where the truck was and just continued onto the shoulder.
