For years I've kept a simple Excel spreadsheet for my online, un-taxed purchases. I use it to complete my La income tax return and I always include a print out of the Excel pages with my tax return listing my purchase data although that's not a requirement of the return.

This is what I have always done as well. It isn't that complicated, and a small tax issue is worth avoiding. Many times a small issue that gets auditors reviewing your return will uncover bigger things.

In a perfect world they could get a list of purchases, go after the people that did not declare the taxes, and file charges. 100% agree this could happen.

Reality, I found when dealing with the state everything is slow. They do not have the manpower, time, and courts do not have the time to do it. Then when someone complains to a lawmaker things will get shite down as politicians do not like complaints.

Which also means when the state does do the work and screws it up and screws you in the process, you are screwed for years trying to fix it...

So Amazon started charging taxes within the last year or two. Where do these taxes go... I thought it was collected in order for Amazon to pay to Louisiana?

Yep, that was my main point in my post on the first page.

It's not the concept of being taxed on internet purchases (which it's own issue/debate), it's LOUISIANA in no way shape or form has the proper records and manpower to pull this off properly. And the only reason they are doing this is because of desperate need of need tax revenues. And once again, instead of going after big fish to cut expenditures, they just throw new taxes at the wall (just like they did with the DMV fines from a few years back) and hope people will mail them a check.

This billing process is going to be a cluster

And I say this as someone who moved out of state 6 years ago, and spent 2 years dealing with LA Dept of Rev trying to bill me for taxes that I didn't owe, proved via certified letter I didn't owe, yet they still sent my "debt" to a collections agency. I then had to deal with the collections agency separately to stop that process and get it back to the pathetic state of Louisiana (by the way, good luck getting anybody in that place on the fricking phone)

And the sweet justice of it all, not only did I not owe them the $3K+ they tried to con me into paying, they ended up owing me $38 in the end. Congrats, Louisiana.

I don't know how anyone deals with those people on a regular basis.

Amazon will report to the state that they charged you the tax and held it for you. Then at the end of the year, they will cut LA a fat check for all of the sales taxes Amazon collected on behalf of their customers

You will not have to pay twice

That's what I was hoping. This will make it a heck of a lot easier to keep some semblance of a track of.

Also refreshing to know that I won't have to pay taxes (again) on all of that.

Who pays the sales tax if your sister in law uses your credit card to buy something for herself and then repays you for the purchase? If she uses your Amazon account it's your purchase. It's up to you to settle up with your sis-in-law to get your money back. You pay the sales tax and she refunds your out of pocket expense for you having to pay it. As President W. Bush once said, "This ain't rocket surgery!"

I did not ask how to settle the payment. I asked how does retailer determine the purchaser. If its by the name on the credit card than great. If its by name on the account like you say then thats problematic for the state and the purchaser for a number of reasons. I guess that also means I can just make up some fake name for an account and never worry about the sales tax.

You show a credit (return) to your un-taxed purchases on your records. That reduces your tax liability from your other purchases.

It's just like you returning an item to a brick and mortar store and your refund includes the sales taxes you paid at the time of purchase.

Sounds really simple but it isn't going to work like that. I buy a one time item and return it to a store I don't shop at. You think the State is going to take my American Express invoice word for it? No they will want a receipt which is something most people in Louisiana will lose or forget about.

I work at Best Buy and since we had a down Christmas because of the internet they're cutting shifts

When you don't support local businesses you hurt your community
I know, FOR A FACT, that Best Buy receives from certain manufacturers the absolutely highest level of discount, the most back-end rebate percent (dollars) and the highest point-of-sale support dollars than any other reseller, whether online or not.

Best Buy chooses not to compete at that level and to make a higher profit to cover the cost of their 6/12 month no-interest financing and other costs. They hire kids that think they're experts when they don't know jack shite, and ridiculously over-charge for cables, sometimes marking them up over 500% above cost.

It doesn't really matter, you can exclude everything you bought on Amazon (and fulfilled by Amazon) from your return because Amazon already collected the tax.

The state doesn't allocate the money by purchaser they get from Amazon. Amazon sends Louisiana the sales tax it collects from all Louisiana residents.

I haven't looked yet in my account but I imagine Amazon could generate a self directed report within your account von nontaxed purchases (essentially everything Amazon sold but didn't fulfill and therefore didn't collect sales tax). Let me know if you discover this capability within your Amazon account.

That's considered tax fraud. You might regret that decision as you would face criminal penalties, on top of the tax and penalties.

This is the second time in this thread you've referred to sales taxes on internet purchases as being "new."

As I pointed out earlier, they are NOT new.

Taxpayers have been required to report how much they have spent on internet purchases for many years on their state income tax return.

The amount of the sales taxes owed are then added to the total tax liability on Form 540.
