Actually, a woman I know was in a pileup around Lafayette and she got sued by the woman that rear-ended her!
Lawyers sue everybody in these situations because they're lowlife pieces of shite...

I know this is crazy, but follow along with me. When the visibility is less than optimal you have the option to not drive or drive and adjust for the conditions.

When driving in bad weather conditions, its the driver’s responsibility to leave extra space between the car in front of them and/or reduce speed.

If someone was driving on I-55 doing 70 in snow/ice and couldn’t brake in time to avoid hitting the car in front of them, would you say that the driver wasn’t at fault for that too? Since the weather made the roads slick and all, right?

Just because the speed limit is 70 doesn’t mean you have to go 70 when the weather conditions are bad and roads are slick or have limited visibility

I am sure there will be a lot of comparative negligence thrown around forcing everyone to "sue their own insurance" company. So, those people driving with minimum coverage will be the ones getting f'ed the hardest.

Even if you were rear ended, they will be looking at were you driving with your lights on, hazards on, did you hit the car in front of you first then were rear ended, what was your speed, did you stay in your lane, were you operating the vehicle cautiously....

I remember watching a news piece (20/20 maybe?) back in the 90s discussing these massive wrecks in fog, and they kept finding high speeds to blame.

Logic would suggest you slow down instinctively in fog since you can't see, but the tests showed since you lack the perception of speed, you speed up. You can't see the world wizzing past you and end up going significantly faster than you think you are.

Just something that has stuck out to me this many years later.

If only they put gadgets in cars that let you know how fast you are actually going it could probably solve this...
