The mother of an 18-year-old girl killed in a crash on I-10 has filed suit against Duck Commander, Inc., the same company that is behind the successful "Duck Dynasty" reality television show. The state of Louisiana is also facing legal action.
quote:
Investigators said she lost control of her pickup and flipped into the median. However, surveillance video from a nearby campground shows a big rig that Madison's mother, Jennifer Young, believes ran her daughter off the road.
quote:
The lawsuit states the accident was caused when "a vehicle being operated by agents, employees and/or licensees of Duck Commander, Inc. negligently cut off Madison Hope Welch and forced her off the roadway."
The lawsuit also cites at the time of the collision "ABC Company was a licensee of Duck Commander, Inc. and was operating the truck."
Young also alleges that the Louisiana DOTD is also at fault. She lists a number of reasons in the suit including "failure to initially design, construct, repair, and/or to maintain the highway; failure to properly install and maintain adequate signs, warnings, or safety devices; and failure to construct and maintain a recovery zone for the highway."

So she is naming DC in a suit because a trucking company was hired to transport freight for them?

She'll settle out of court for 6 duck calls and a pair of Uncle Si tea glasses.

She is looking for someone to blame

DC has money, lets sue them!

OK. Here it is.
frick LAWYERS.
You want to sue someone for a specific negligent act? Fine. But naming everyone and their momma in a shotgun attempt to get some cash? frick you.

I feel sorry for her loss...but suing people who had nothing to do with anything is stupid.

That's how these type of lawsuits work. They throw everyone they can into it.

Rule 1 of law suits; sue everyone and let the judge sort it out . Standard opperating procedure.

18 year old girl should've been home perfecting a brownie recipe in hopes she ever marries. This is the moms' fault for letting her drive- she surely could've walked to borrow a cup of sugar.

I feel for the poor woman who had to bury her daughter, but c'mon. Unless the video is much clearer in person, I have no idea how you can positively identify who owns the truck in question.
Also, how is DC responsible? The trucking company would be a contractor, so the trucking company would be responsible not DC, correct?
I'm an independent contractor. If I'm en route to a job for XYZ Network and have a wreck, I'd be responsible, not the network. Is Louisiana law that much different than everywhere else?

I would think that the trucking company's insurance policy would cover DD up to at least 2 million. Hell, when i owned a concessions business, I had to cover event management up to 2 million.
