it's not just that. there aren't real penalties for lying before litigation. when litigation commences and discovery/depositions become and option, lying has a much stronger penalty.
i do like the concept of giving notice of a suit and having sort of a pre-suit period to determine the liable parties

Eyewitnesses state that the big rig ran her off of the road and the traffic cam shows the truck beside her truck moments before the accident. Did the truck driver just keep going and never stop at the time of the accident?
I bet this happens a lot, I've been forced onto the shoulder when a truck driver gradually veered into my lane before.
