Records obtained by WAFB show the First Circuit Court of Appeal reviewed the records in the case and wrote that, “In light of its unique facts, we conclude that justice will only be served if the defendant is granted a new trial where a new jury will have the benefit of all the evidence. It is the paramount objective of upholding the integrity of our judicial system that dictates this result. Convictions and sentences vacated; remanded for new trial.”

According to the ruling, the court said evidence was not presented that could have helped Curtin defend herself.

Why didn’t her lawyers provide the evidence?
Am I missing something?

It's the rules. Can't withold evidence that could prove innocence.

Assuming that prosecution had the evidence and didn't share it.

The prosecution has control of the evidence. They apparently "forgot"'about some

This should not help Ard. And I am fine with that.

They railroaded that girl from the beginning. Everyone was out for their pound of flesh and she was the first served up.

I actually knew Mel and Jason - when they were married. She was sweet back then…although when Jason divorced her, I think she went off the deep end. Has 2 great boys. My son played ball with the oldest.

That’s kinda where I was going with my question
They are required to turn over what they have
I am guessing they can just “forget” & if they get caught the conviction is over turned & they start all over at tax payers expense without any sanctions?

curtin got life/no parole and Cynthia got 41 years. Doesn’t seem equitable to me. Let curtin plead guilty, give her 20 and give the victim some peace

What makes you think it was her attorneys and not the prosecutors?

State didn't hide evidence. An affidavit was located by Perkins' attorney from a 2006 divorce case in Alabama that was relevant to the victim's credibility. That attorney turned it over to Melanie's attorneys.

Her time never seemed right to me. Guilty, but her association with Perkins resulted in a ridiculous sentence.

Is there any updated pics for research purposes? She may need a pen pal in the future

Pretty sure she was offered a better deal than 20 and turned it down to go to trial.

I mean sexual assault is wrong, but why did he get a life sentence? And what did this woman have to do with it?

Did the victim's credibility play any role? I thought the main evidence was a video of the incident (which speaks for itself).

Mostly that WAFB's articles are usually terrible. Like another poster said, her attorney didn't know about the affidavit until after the trial.
