maybe he didn't become fearful until after the window was down and felt he was being attacked? That only took me 2 seconds to think of. That's why I hope there is some kind of video to show us.

Sounds like the initial story was brought to us by the same witnesses who saw St. Michael Brown executed by a cop while his hands were up.

Only if the shooter was in reasonable fear of imminent death or grave bodily harm.

If McKnight is just at his window and yelling at him or something to that effect, then no it wouldn't be justified.

Serious question because I don't know the law. Why did Cardell have to stay in jail while Gasser doesn't when both will be making arguments for self defense?

Possibly, but the orientation of the car doesn't suggest he was trying to turn. Perhaps it has been moved, although that doesn't make sense for the investigation to move it.

In other words, if the Audi wasn't moved, it doesn't look like McKnight had any intention of turning in that lane.

I don't know what to think about this. When the the story first came out, the witness's account is what painted the picture for me, as to what happened. But her story was complete fabricated right? Isn't that a crime?

Anyway, I can sit here and say "why didn't he just do this or he should have did that", but its one of those situations in which its easy to monday morning quarterback if you never been in that exact situation. After reading through some of this thread, it seems like JM exited his car, went to the window of the shooter's car which is when the shooter shot JM.

Was JM just standing outside of the shooter's car or was he trying to get into his car?

Could this be compared to the Will Smith situation in any way?

I am unsure how people on here think they can shoot someone who is unarmed for yelling at them. If I am wrong, I would like to know how.
You don't see any exit ramps between standing outside yelling and being inside the vehicle?

cardell chased someone down, slammed into their vehicle, exited vehicle with a firearm, shot a man dead and his wife gunned down too. Will Smith shot at his own vehicle.

Murkier for sure. But that statute states the intruder can be "attempting" to enter the dwelling or motor vehicle. So yes they can be outside the car (I presume).

Since the driver's side window was half way down, the passenger side was probably like that too
