A Texas man is suing Whataburger after he requested no onions with his meal but got them anyway, according to a court filing.

The lawsuit was filed last month by Demery Wilson in Texas' 269th Judicial District Court of Harris County.

The documents claim that Wilson visited a Whataburger location on July 24, 2024, and ordered a "fast-food meal" without onions, according to a copy of the filings seen by Fox News.  

However, Wilson claims that the order did contain onions — which apparently then triggered an "allergic reaction" for which "he had to seek the care of medical professionals."

Whataburger denied Wilson's allegations in a separate court document filed on May 16,
demanding "strict proof" of his assertions.

Not if you are allergic, but I always check my order before leaving the window, but I don't do much fast food.

You guys hate on Europe all the time, but they are really good at identifying potential allergens in foods. This applies to both packaged foods and restaurants. This might not be an issue to many, but if you are a family member has food allergies, it's comforting.

I call BS. If you are allergic enough to have to “seek medical attention” then you don’t eat at a fast food restaurant that has that food.

Cross contamination would be just as bad as eating the actual food item.

*my wife has food allergies to most of the night shade family of foods. (Peppers/skins of potatoes/eggplant) if a knife cuts a pepper (including a bell pepper) then cuts something she eats she will have a reaction. So we do not go to low end restaurants that have peppers.

EDIT: no different then people with tree nut allergies not eating foods items from facilities that also process items with tree nuts.

lot of fast food places will shatter those expectations for you
some people check before eating every time and there’s not even anything that can hurt them!

If that sensitive to onion allergy, would be on alert for them and not assume the 16yo girl with 2 nose rings and 10 earrings that served it to you had your histamine levels in her priority focus.

oh the guy is absolutely a dumbass for not at least checking.

just answering the question as to "what was he expecting"

I mean I know standards are low in this country, but getting what you ordered should not be considered above expectations.

Then don’t order a fast food meal that comes with onions. If you have allergies don’t go to a place that has whatever you’re allergic to. This isn’t rocket science, at some point personal responsibility needs to play a part in things

You tell them you don’t want extra onions and they will give you them…
