They are either the shittiest friends in the history of ever, or she wanted him there. Doesn't mean she necessarily wanted to sleep with the guy, but why let a guy you just met that night stay at your apartment alone with you unless you wanted him there?
Dude has a criminal history so it doesn't bode well, but I don't 100% believe the woman either.
I'd be interested to know if he was also intoxicated. If so, they are both legally impaired and cannot "consent".
Not trying to defend the guy per-se, but plenty of women lie their arse of the next day because they regretted what they did.
Genuine question for the OT lawyers, how do you even prove rape in a case like this?

Gonna be hard to claim he was intoxicated to the point of being considered incapable of consent when he drove her car there.

I'd take a DUI over a rape charge though. Although I'm not a lawyer so I don't if it works that way.

Well they wont be able to prove enough to give him a DUI. It just weakens any "i wasnt coherent enough" argument.

There is no DWI investigation, can't prove the BAC level even if he was observed on surveillance drinking at the establishments.

They had to leave the bar at 2 am, right? And the "friends" left her alone with him at 4:30. That is two-and-a-half hours to sober up.

They could have continued to drink at the woman's apartment after hours, the investigation was unclear on that.
