But I think the information we have makes it fairly clear Brooks was a woman that liked to have frequent sex with men

We all have our opinions

I THINK brooks wanted to have sex that night. I think if she would have lived she would not have had regrets in the morning and everything would have preceded as normal that night

However. She did die and this case presented itself

I think based on the defendants testimony it was clear they knew she was drunk. They knew what they were doing was not consensual based on her inebriation

I think the prosecution is very lucky the defendants were dumb enough to speak because without the testimony the physical evidence at hand would have been dicey as hell

I think both legally, and more importantly morally, they are guilty of third degree rape

There have been several threads on this since it happened. It's been discussed from just about every perspective.

In addition to her BAC, she was unable to provide her address or give directions to her residence. She was so disoriented she wandered into the path of an oncoming vehicle. IMO, this is pretty conclusive she was incapable of giving consent.

That is the pivotal issue. Whatever, her past actions were they are irrelevant.

When Madison was first killed, the suspects turned themselves in. They were concerned they would be charged with murder. In their statements, they confessed to having sex with her and that she was exceedingly drunk. Not sure if those statements to the sheriff are admissible evidence but they're on the record.

The defense has waffled. At first, they wanted to argue it was consensual. Then when lab reports came back without evidence of rapists' bodily fluids, they seemed to shift approaches to 'they never had sex to begin with.' No idea what they're up to now. I don't see how they can argue the latter unless they've effectively scrubbed all the evidence as well as EBRP's collective memory.

And since it's been two years, it may be worth mentioning:
- She went with them because they told her they would give her a ride home.
- Not far from the bar is where they raped her.
- When she was unable to provide directions, she was let out of the car. It was 33 to 34 degF at 2AM that night. A British newspaper stated it was raining. I could not confirm that and don't think it was.
- They had options. There was a police precinct in proximity. Could've called an uber. Could've called 911. Could've taken her to a convenience store.
- So let's ask, who offloads a disoriented drunk girl at 2AM in freezing weather in a strange setting when they were other options readily available?


PS: There was a poster, "JudgeHolden," who posted extensively in the first thread on this case. I think he was a lawyer, not a judge. He hasn't posted since 3/9/23. Just wondering whatever happened to him.

Broadly speaking I agree, but there are some cases where the juice is worth the squeeze, so to say. I haven't seen pictures of this chick so I don't know if it applies here, but let's not paint with a broad brush.
