What rumors? She might've had sex the night before. Was it with a boyfriend? Something more casual? Who knows?

I think you are emotionally arguing with people that are legally arguing. Right or wrong, not everyone thinks the same as you. So if there is a jury of six, five of them have to have to vote that they are guilty of rape beyond a reasonable doubt. If just two of those jury members think that there is any reasonable doubt, they will get off. At the end of the day none of us have nearly enough info to make an accurate judgement of what the outcome will be.

It won't matter for 3rd degree rape. SHE.COULD.NOT.CONSENT.
I don't know why y'all think that doesn't matter, it's exactly what 3rd degree rape charges are for. I still question whether something even more nefarious happened, but the evidence/prosecutors/DA have to make those determinations of what they think they can convict on.
