Driver charged with Aggravated Obstruction of a Highway of Commerce. This charge applies to any negligent or intentional action taken on a highway which results in death or injury to any person. LRS 14:96. It’s a felony. The nature of the action in this case (aggravated flight) is such that the passenger can be charged as a principal. A principal to a felony bears the same responsibility and faces the same punishment as the actor. Here, both can be charged with first degree homicide. First degree because a peace officer was killed. It will be up to the DA or Grand Jury as to how the two are formally charged.

Expect a lawsuit against the Hammond Police Dept. and the officer driving the car that hit the Troopers based upon what I have heard about the way it happened.
If true, this would change the perps being charged with murder.
Or should I say: being convicted.

As LEO, who has been hit by a car in the line of duty these stories always crush me.
So fricking awful. Deploying stop sticks is very terrifying and several times a year officer’s are killed LOD by being struck by suspect vehicle while deploying sticks.
Not sure I’ve ever heard of being hit by another PD. Just terrible and the officer who hit the 2 troopers will live with that for the rest of his life. Not sure if poor training, situational awareness etc but that’s terrible.

I'll probably get a bunch of downvotes for this, but I have mixed feeling about that being a murder charge.
So much for the "not one white person will make an excuse. We believed in consequences". LOL

A question did they strike the officer who died in anyway? They may have caused the chase but an over zealous Hammond cop killed the LSP, i doubt they get a manslaughter charge to stick

Believe what you want. The law is clear.

There are implied risk in law enforcement. If an officer or agency takes a risk in their tactics and subsequently is killed, the pursuing felon isn’t criminally responsible,
I'm sure it varies state to state, but as I understand it if a cop kills himself in a crash during a pursuit the person being pursued will be charged with the death.

Try this wording: "If a cop is killed due to suspects further crime of endangering public by fleeing they will be charged with the officer's death .

It’s felony murder, but what circumstances allowed a traffic stop on a “suspicious vehicle”? It takes more than that to flip on the lights.
Trespassing on private property after hours....just a thought

Yep, sounds like HPD

And just like that you catch a manslaughter case.
Gonna be much worse for them than manslaughter

Why do they even chase punks like this? Get the license number and pick them up later. Unless it's someone suspected of violence, the chase endangers society more than some suspected drug user.

When the officer tried to conduct a traffic stop, the driver took off at a high rate of speed and the officer saw occupants throwing items out of the vehicle.
The War on Drugs is stupid, and its way past time for us to find a better way to fight drug addiction.
But there's a ton of money involved in:
Law enforcement
Prison system
Pharmaceutical industry
That doesn't want there to be an end to the "war".

You shouldn't get downvotes. High speed pursuits over non-dangerous felonies are insane and reckless.

If you have shiny tools, you want to use them.

Pick who up later? The occupants would be unidentified. How do you prove who was driving the car?
