Judge tosses out case after woman's attorney refuses to wear a mask in court

Guess contempt of court wasn't good enough for the judge. I would say something needs to happen to the judge for this overreach but it is in NY so he will probably be given a medal for his bravery.

The New York Daily News reported Friday that Brooklyn Judge Lawrence Knipel tossed the case after attorney Howard Greenwald said he could not breathe wearing the mask in the newly reopened court.

“I want the record to reflect that I am speaking with great difficulty,” Greenwald, 68, told the judge. “I want to the record to reflect that I am sweating profusely from the effort.”

He said, “I just can’t do this,” according to the transcript.

“I don’t contest the rule,” he said. “I just am not physically able to comply with the rule to do my job as a lawyer.”

Knipel, who was hospitalized with COVID-19 last spring, insisted the lawyer comply with rules requiring masks in all state court buildings.

“Forget about my personal experience with COVID,” the judge told the newspaper. “We have over half a million dead in this country. We have protocols. The most important protocol is wearing a mask.”

The lawsuit focused on a 2017 car crash that fractured the woman’s leg.

Knipel told the newspaper the woman would have legal recourse to continue her litigation even though he dismissed the case.


I despise personal injury cases as much as the next guy but what good does it do to delay this woman's day in court?

Was that a little disingenuous of the judge to say that? Is he suggesting she has to appeal his dismissal or is he suggesting she has to sue her lawyer and allege he malpracticed?

So, the system allows personal injury cases, but one person can bypass that based on some retarded mask rule?
Sorry, but I'm tired of the mask mandates much worse than personal injury lawsuits.

Willing to bet that this was one of those “oh no, my back done hurt” cases that the lawyer didn’t want any part of.

It could have been, but there was definitely an injury involved.

Probably without prejudice. She just has to re-file.

If the judge dismissed the case w/o prejudice, she may be able to refile her suit.
