Is this pistol legal?

From an ad on Tigerdroppings. I thought sawed-off shotguns were illegal, even though I saw a pistol at a gun show years ago that shot .410 or 45 cal.

If a Judge is legal then I see no reason why that wouldn’t be also.

That thing is some weird assembly of parts that skirts the law. I think it is a black powder or something. I can't remember but I saw one at SHOT show and decided it wasn't worth the trouble.

Shotguns with barrels less than 18" are illegal. What you posted a picture of is a pistol. It makes a difference. Shotguns, rifles and handguns are 3 very specifically defined things. For instance, the gun in your picture doesn't have a stock, by definition a shotgun has a stock. So, this can't be a shotgun as defined by the ATF. But it can be a handgun, which doesn't have a barrel length restriction like shotguns do.
ETA: Just now seeing this may be a blackpowder gun, which also changes things.

That is why the Judge and Governor are legal, they shoot a pistol cartridge, namely a .45 long colt. If they were just a short shotgun then no.
The pistol pic you posted gets around that being a muzzle loader.

Yeah, these NFA laws date back to the Gangster days of the 1920s. It was the governments attempt to get certain "dangerous guns" (machineguns, short barreled rifles, short barrel shotguns, silencers and destructive devices) registered and taxed ($200 was a lot of money in 1934). The barrel length restrictions were put in place to reduce the concealability of shotguns and rifles. It's pretty much a joke now with all the loopholes exposed surrounding barrel length restrictions.

Once a long gun (shotgun or rifle), ALWAYS a long gun. And with that, you have to address barrel and overall length.
However, the key point is that it has to at some point be a long gun. What it's chambered in is irrelevant. If it comes from the factory and never has a shoulder stock attached to it, it does not meet that definition. Instead, it's a "firearm", plain and simple.
The Mossberg Shockwave and Remington Tac-14 are examples of "not shotguns", and laws pertaining to shotguns do not apply. That's because they have never ever had a shoulder stock on them. If you took a regular shotgun and cut the barrel down to that length and removed the buttstock, it's illegal. You can't MAKE a Shockwave. But you CAN buy one.

I own a single shot .45 derringer similar to that pistol. The barrel is clearly labeled .45 Long Colt, although a .410 shotgun shell will fit right in there.
FWIW, shooting a .410 slug outta that little thing will have your hand throbbing for a few minutes

it could get sticky as pistol's with a smooth bore are generally considered an AOW requiring a tax stamp.

Don't think it falls under AOW rules as it's not legally a technical firearm. I saw some similar commentary around a batch of rare gun pens, black powder shooting a BB or something.
