Yeah this whole notion that no damage means they claim will be dismissed is bogus. The system is set up such that paying to settle when you're at fault is much easier than fighting it.

I wish there was a way to call out this type of bs. Same thing happen to me insurance SR paid 6k . Barely hit the car ( no damage to truck) and it was a POS car . Totaled it would have been worth less than 3 thousand . These frauds drive insurance rates up and deserve to be prosecuted

Several years ago, I was behind a car approaching an intersection, when a cop flew through the intersection, running a red light, with no lights or sirens. The guy in front stopped immediately and I hit his rear bumper.
We pulled into a parking lot. It was an older black gentleman with a black eye.
The hit caused his bumper to be pushed in slightly (older Cadillac with chrome bumper and bumper shocks.) We pulled the bumper out and chatted a sec while the cop drove up.
The old guy said everything was fine and didn't need a police report or anything. No damage. Everything was cool.
The cop then asked the guy if I had punched him in the eye. The gentleman looked at the black guy and said "Hell, no. Are you crazy? Wouldn't I have told you?"
And then, I point out to the cop that one of his cop buddies went through a red light with no sirens and no lights. The older gentleman agreed and said that was the real cause of the accident.
The cop kinda retreated and said, "Okay, we're all done here." and sped off.

I really don't know. Call your insurance. What does the police report say? Does it describe the damage? Either way, I don't know how it's done, but these fricking lawyers know how to work these insurance companies.
Years ago my dad was at his sister's and was about to leave. Her house maid was finished and needed a ride home so my dad's sister asked if he would bring her home.
Several months later he received a letter in the mail saying his auto insurance dropped him due to a recent lawsuit. The guy who owned the insurance branch lived down the road so he went talk to him.
When the maid got out of his truck she kind of tripped on the truck floor getting out (my dad said he remembered that she kind of stumbled.. Nothing dramatic at all.. It was just one of those "you okay" situations when you ask to be polite, but you could easily see it wasn't anything that needed further attention). She sued his insurance and he had no idea she filed suit until he received the letter.
The insurance guy fixed him up so that he could remain a customer and at that time the rate stayed the same, but about 6 months later it had gone up a little bit, but all these minor situations results in everyone paying higher premiums, etc.
You have to be a complete shitbag to make a living waiting for people to get into situations where they can claim they were hurt in order to make a settlement with insurance companies.

About 10 years ago I barely nudged a lady at a redlight. I didn’t even really hit her, it was just the rocking of the car after you hit the brakes. There was zero damage to either car. I took pictures of both cars and this pissed her off.
Didn’t even scratch her “Obama” bumper sticker. (There’s a bit of info for you.)
She insisted that we wait on the side of the road for nearly two hours for a cop. She had already called 911 before we even pulled to the side of the road. She spent the entire time complaining about the cop taking too long to get there. Once he arrived he took all of our info and gave us the report numbers and such.
About two weeks later I get a call from my insurance company informing me that she was suing. My agent on the phone told me that the shop she took her car to only charged $40 for repairs. He told me that was smallest claim he had ever seen.
I asked him what the plan was with regards to her lawsuit and he chuckled - I was her third active personal injury car accident suit and her second in less than a month.
I never heard another word. I asked a couple of years later when I was getting a new car and the person on the phone said that they resolved the claim without a payment.

I honestly have no idea. This was a long time ago. If I recall my dad use to keep his insurance information in the window visor. face forward. Maybe she asked my aunt? I really do not know, but I wouldn't have thought you could even sue someone's auto insurance for something like that, so I wouldn't even make up some shite like that.

He has obviously received some coaching on these situations and is going to do his best to seize this opportunity for a payout. This may not be his first rodeo. I guess a lot will depend on the report from the medical exam and whether it was prepared by someone who is sympathetic to his ruse. Whether he gets paid or not, it's going to cost you. My friend just went through this in a very similar situation. The guy didn't get anything but my friend had to spend some money to ensure that he didn't.

Follow him on facebook if you can. Print any activity he does with that "bad shoulder" over the next few weeks. Give it to the lawyer. This helped in a very similar accident my wife got into. The insurance lawyer had a good time busting the other attorneys balls. They did get paid but nothing close to what he was hoping.

Love how all this shite in car wrecks can get quick checks for people that don’t deserve it, yet when 18 wheelers on the interstate kick up huge rocks destroying people’s windshields there’s nothing you can do and it’s no ones fault
