The irony is that actually showing your id in this case proves your innocence.

The American thing is that you aren't supposed to have to "prove your innocence"...

This logic is so fricked up. In this situation he should have one objective in the heat of the moment. Deescalate the situation for his own safety. That would happen if he showed his ID.

After that he can yell, curse, scream about his rights, etc. but no reason to risk personal injury or death to prove a point.

You are either cool with "show us your papers" are you aren't, I like you are not.

I would have been in the same position, the chances of me having my ID with me in the yard playing with my dog is basically zero. If I wanted to show him my ID I would have to go in the house, the cop would not let me go in the house alone and he sure the frick ain't coming in my house and I am not involving anyone else in the matter.

This is fricking america... you shouldn't have to do a god damn thing to deescalate a situation where you've done nothing wrong and an armed public servant enters your property under false pretense.

his safety wasn’t in question. The only threat was a police officer saying “show me your papers”

So you're saying cops are irrational?

Seems pretty simple. Even if you don't "have" to do it, why not just easily resolve the situation and move on? Neither party handled this well. When did people forget to just act like reasonable adults? Maybe the guy had some unpaid traffic ticket with a bench warrant and that's why he didn't want to simply show his ID and tell the police officer - see it's not me now have a nice life. I guess I could understand not showing ID in that situation.

I completely understand the guy being pissed. I would have been too.

But when you don’t cooperate, you make a bad situation dangerous. That’s just the reality.

Of course some are but not all of them. They are humans. You have irrational people in any profession, particularly ones with high stress and risk of life.

Was this officer wrong? Absolutely. And I would have been pissed. But at the time I would think this guy is irrational and I am going to do everything I can to avoid escalating the situation.

That’s just me but If you want to potentially fall on your sword to prove you don’t have to show your ID then go for it.

If you are in your yard, playing with your kids and dog, why should you show them a damn thing? This whole ID thing is an overreach.

I'm curious, while it is not a perfect analogy what would you say to a cop at your door who just wants to come in and check the serial number on all your guns because some were stolen and a person told the cops it was you. I mean you could just cooperate.

Question for the legal experts. If a cop rolls on you for any reason. Are you legally obligated to show ID when requested. I thought you were but I feel like I'm wrong now.

If this guy didn’t wanna get shot he should’ve stopped acting like a criminal

The person who should be deescalating is the police.

Stop pretending the cop rolled up all personal like and said howdy, I’m looking for a fugitive who kinda looks like you. I’m sorry to bother you but would you mind....

Let me help you out. Most people don’t like being accused of being a criminal when they are innocent.

Innocent until proven guilty.

That is stupid of him... If the officer is calling him by a different name it is obviously a case of mistaken identity why would you refuse to show your ID?

The black dude did not handle that well.

I didn't see the pic the cops had, so do we really know if the guy looked like the perp or not?

It says Texas law states you don't have to show ID until after you're arrested. Sure, but call me crazy, but I'd rather go ahead and show my ID before I'm arrested and have that incident over with well before it was over and without any threat at all that the officers would do something stupid.

I certainly have empathy for the cop coming into his yard with his kids out there getting the wrong guy. I can't imagine how mad that would make me if it happened to me. But that still doesn't mean he handled it well.

The video says Texas law states you're not legally required to unless you're arrested.

What's your backup plan for proving you're not the criminal the cop thinks you are?

Innocent until proven guilty. Guy wasn't acting like a criminal, he playing in his front yard. The burden of proof lies with the over zealous police officer.

Are you saying cops should never try to detain someone and ask for their ID when that someone fits the description of a wanted criminal? Is that what you're saying?
