Oh that cop handled it wrong, as did the landowner.

I’m white and got pulled over once long ago. Got out of my car pissed after cop had my license for 5 minutes or so. When I got out to ask wth was going on he immediately said get back in your car, I did.

Couple minutes later he brought me my license, apologized as he told me my car matched the description of one used in a robbery but I was clear to go.

Sure. Not sure why you think this is some gotcha.

Do you think all black guys with dreads look the same?

Do you think a cop can't see known addresses for a person and their acquaintances?

There are multiple ways for this cop to have figured out this wasn't the right guy. He chose to ignore it.

Imagine you're in your front lawn with your kids and someone tries to arrest you because he thinks you're someone else. You aren't going to be mad? You aren't going to feel like your rights are being violated?

It's not your duty to submit to a cop's will when he's an idiot making a mistake. Individual freedoms should not be so easily sacrificed in the name of even public safety.

I am not talking about just THIS specific situation. I am talking about general situations. How will it ever be obvious that you are wrong (as a police officer)? Just a persons promise they are not the person in question?

I seriously don’t understand how a conclusion can be made unless you have ID.

I do not think the cops know every single address of every single friend or possible house a perp may be at, that is essentially what you're asking. The guy could have gotten a new girlfriend in teh past week, boom, he's at an address not on their list.

Of course I'm going to be mad. I'm also going to show my ID, resolve the issue very quickly and not hire a lawyer to sue. I'm pretty confident in that.

Dude has a legitimate gripe. Cop way overstepped his bounds and needs to be disciplined. The man wasn’t doing anything detrimental to the community.

So the cop goes up to him and says he looks like someone they are on the lookout for. The argument ensues. Another cop brings the picture and shows it to the first cop. First cop says, Oh, it's not you but looks like you.


Why didn't he look at the picture first so he could know what the fugitive looked like?

If an officer has reasonable suspicion you have committed a crime you are obligated to provide identification or he can detain you until you can be identified.

I believe that you are only required to honestly state your name. Then it is up to the LEO to confirm.

But if the officer has reasonable suspicion the 4th doesnt protect him from being detained and identified.

Even if the suspicion is wrong as long as it was reasonable the officer has the power to detain and identify him.

Depends on the totality of all the circumstances.

Without all the information pertaining to the situation, how can you determine what's reasonable or not?
