Hit by an uninsured driver

Happened last week on the causeway - traffic came to a stop in the right lane in the fog for some dumbass reason, left lane was closed. I stopped, got rear ended and pushed into the pickup in front of me. Nobody is hurt, brand new car with 1500 miles on it has to get towed off because the trucks bumper crushed everything from the headlight into the drivers side wheel well. Cop takes all our information, lady that hit me gets the ticket and put at fault.
Insurance company gets the police report and the insurance card she gave to the cop was phony. No telling if her ID or plates/registration are legit yet, it's being checked.
Any of you been in this situation? I'm going to be on the hook for the deductible now, but isn't presenting a phony insurance card a felony? I started the process with Causeway PD about this. If my car gets totaled out, I'm going to be one pissed off equine because I didn't get gap insurance on what amounts to a grocery getter on my days off at home.
Advice appreciated in advance.

You’re going to get it from both ends.
Your insurance company will frick you over the uninsured driver while the truck driver’s insurance is going to frick you because your car hit them even if it wasn’t your fault.

Do you have underinsured/uninsured motorist coverage on your own insurance? If so, reach out to them. It will likely require opening a claim.

I’d imagine she got a ticket. Go to the traffic court prosecutor and explain what happened. Restitution through that system has more teeth than trying to collect a judgment against her personally.
Would likely at least get your deductible back as part of her sentence for the ticket.

What a lot of those folks do is after buying their 2014 Altima, they get insurance coverage and pay the first month so they can take the insurance card to the DMV to tag out the new whip. Then they proceed to never pay the premiums again yet keep said insurance card with them in case they get pulled over.

If driver was an illegal you are probably triple fricked. Hopefully her other identification was real so there is at least a person to go after.

This is why you buy full UM coverage for bodily injury, and also why you have comprehensive coverage.

Happened to me. Nothing happens to these trash humans either.
You'll have to file a collision claim and pay your deductible since in Louisiana the Uninsured Motorist coverage only covers injury and property damage.
They'll go on their way and not even get a ticket.
But you know if you were at fault they'd be calling Gordon.

Why not? Gap insurance is relatively cheap. If you're already paying notes and full coverage insurance on a brand new car you might as well just add gap for things such as this.

Right. There’s a huge risk of being hit by an uninsured dirtbag, hence, the higher premiums for these coverages. I’m guessing OP opted to save money each month and take the risk. Sometimes it pays off, sometimes it doesn’t. Who’s to say he isn’t smarter for saving his money on insurance costs every month?

Plaintiff Attorney's are notorious for telling their clients to lie & say they felt 2 impacts instead of one so they bring in both vehicles insurance companies & extract both policies. Nothing will happen to the person with no insurance. Welcome to your new America.

Happened to a guy I worked with. Dude was illegal and skipped town and he was stuck paying for it.
