My unscientific guess is that 25-30% of drivers in texas do not have insurance and are stopped but not ticketed because the judge will not fine the person who cannot afford to pay.

You should read the whole thread. There's this amazing post where I stated that I do have uninsured motorist coverage!

Good luck arguing your fender bender is a bodily injury claim (at least in LA).

They really need to start cracking down on these drivers without insurance coverage. I have 3 different relatives that have gotten into accidents within the last 6 months and all of them were caused by uninsured drivers. It's ridiculous.

Then why so they try to sell it to you if it isn’t allowable? Have to sign a declination of uninsured or underinsured vehicle if you don’t want it. It’s on my card I have it with full coverage.

I've had that happen to me 4 times, well to me and my kids all total. It's sickening. The 4th time the trooper came talk to me and I went off and said if he let's them get away I'm gonna go nuts about this. He cuffed them and put in back of his unit. Sad part is, prob let them go later. One of the officers from a previous wreck told me that he didn't fell like dealing with it bc it takes several hours to process them and he gets off in 1 hour. I'm like why can't they just deal with the problem.

Uhhhhh the accident report from the officer should make it clear who is at fault.

Uhhhh the officer can't determine at any level of certainty who is at fault and how to apportion blame when 2 or more cars collide behind the front vehicle. Without clear video or excellent eye witness testimony it is hard to determine if cars in the middle of a pileup have any blame and if so how much.

Back in a previous life when I did insurance defence work I hated the rare multi-car case that went to trial, they were always a clusterfrick. The plaintiff will file against every car behind them until their is a break in the chain and the trail revolves around everyone eliciting very specific (usually clearly well rehearsed) testimony and if the damages are high enough accident deconstructionists and engineers.

In general, these are the types of cases just worked out between the insurance companies apportioning blame in some basically random way because for them it all evens out over time and many accidents. Uninsured drivers in the chain are just another issue for the insurance companies to work around.

Sad thing is it’s probably only going to be more common with the cost of insurance skyrocketing
