If the officer had a mobile data terminal in his cruiser he had access to dmv insurance database.

If you live in LA you should carry UM policy. 40 percent of drivers in La are either under insured or have none at all.

Hitting your UM policy won’t affect your rates. Hitting your collision/comp will.

Really nothing you can except sue and get a judgement against them. If they get a windfall down the road you can get your money. Otherwise your SOL.

Had something similar happen years ago on a brand new car. You’re going to be forced to make a claim with your insurance. The worst part was how long it took for them to a check while needing to pay for a rental car…that shite adds up.

I hope you have as much Uninsured Motorist Coverage hat they allow you to buy.

Lots of folks buy cheesedick 100,000 Liability. Or less. They need at least 500,000.

That way they are covered. And you sue your insurer. It’s the coverage you will most likely need to claim n Louisiana.

Uh, lead car's insurance is absolutely going to rule OP at fault.

Leave enough spacing to not only not rear end someone, but to also not get pushed into them.

Uhhhhh the accident report from the officer should make it clear who is at fault.

How can the lead car sue someone who is not at fault?

BTW this exact same thing happened to me. I was not sued.

This might be the dumbest response of the thread. Congrats.
I'm supposed to be a frickin mind reader and pop it in reverse to make a larger gap after coming up on stopped traffic in the fog? You're dumb.

Yeah I'm doing alright. Docs ordered a nuclear bone test on me for April and won't tell me why, so that kinda has me rattled - but other than this and that I feel good. Everything okay?

This is correct:

quote:

Doesn’t matter. You cannot have uninsured motorist property damage in Louisiana if you have comp and collision. It is literally not allowed

You other guys either don’t live in Louisiana and have different laws OR have no clue what you’re talking about re: UM coverages.

Literally not legal to have uninsured motorist property coverage in LA if you have collision coverage.

That is what uninsured motorist is for. But there are 2 kinds, one only cover the damage to toe other car while the other protects you. Sounds totaled. Good luck!

Holy shite there is so much misinformation in this thread.

You realize that one driver’s insurance company doesn’t just get to “rule” on who is at fault, right?

What kind of UM coverage do you have?

You said car was financed, so if you live in LA, then you only have UM BI if you also have Collision/Comp as required by any leinholder.

You don’t have UM PD coverage if you’re a LA resident and also have collision/comp, which I assume you are based on you stating car is a grocery getter.

I was hit by a woman who failed to yield because she was messing with her radio and turning at the same time. She hit me on the front drivers side and sent me into a telephone pole which resulted in my vehicle getting totaled.

She had insurance... but she had just got it a few days earlier and evidently her coverage didn't kick in until after 2 weeks or something. I had to go through my insurance and supposedly they were going to sue her insurance, but it was a bitch to deal with.

It really is shite that you pay your insurance and if you get hit by someone who doesn't have it you have to then go through yours and nothing really happens to them.

This is one of the reasons I have a dash am that records my speed too. I have proof of everything going on in front of my truck from side to side and about 10-30 yards in front

It would show me stopped and how far away from car in front of me was it’s also useful if you go to court over a speeding ticket that’s states you were going faster than what you actually were going.
