Hiring a lawn man

My sister had a lawn man for the last 3 years and while mowing he trips in her yard. He hurt his shin and chest and is in ICU. What is her legal position?

Well, since all lawn men pay taxes and also hold the required workers comp insurance, she should be fine unless she did something negligent to make him trip.
