Even if she did nothing to cause this, even if she had him sign a liability waiver, even if he was falling down drunk on the job, she could still be sued if the guy finds a lawyer that will take the case. The good news is her homeowners insurance will probably provide legal defense for her who will likely settle regardless of what happened.

Actually if the hired lawn guy doesn't have proper insurance , he can sue her for getting hurt on her property. That is why you have to always make sure when you hire someone they carry their OWN insurance or you are on the hook if they get hurt. Waiver or not, a good attorney will find a way to make her liable. Yes this sucks but that's Louisiana for you.
