I thought if you killed someone in the process of committing a felony than you were charged with murder. Am I just making that up?

Some states have that law. Not sure if LA does.

We do. It also includes your buddy getting killed during an armed robbery for example. Whether he's shot by a cop or you two crash the getaway car. Not necessary that YOU actually kill him. But if you were both committing felony together makes you potentially responsible for his death.

Good ole Simon B-Law Criminal Law chapter, spring 1997.

pretty sure we don't have felony murder. iirc, every way you can get 1st degree murder will involve specific intent to kill

2nd degree murder has the "felony murder" stuff, but only for specific crimes

quote:

§30.1. Second degree murder
A. Second degree murder is the killing of a human being:
(1) When the offender has a specific intent to kill or to inflict great bodily harm; or
(2) When the offender is engaged in the perpetration or attempted perpetration of aggravated or first degree rape, forcible or second degree rape, aggravated arson, aggravated burglary, aggravated kidnapping, second degree kidnapping, aggravated escape, assault by drive-by shooting, armed robbery, first degree robbery, second degree robbery, simple robbery, cruelty to juveniles, second degree cruelty to juveniles, or terrorism, even though he has no intent to kill or to inflict great bodily harm.

Gary and SWB want to try and justify letting a murderer go if he causes a high speed chase?

Gotcha. I knew I recalled our class example was a bank robbery, thus the inclusion of armed robbery.

Thanks .

So I guess he was out on bail for the 2016 charges.

Oh, wow. Didn't realize that was prior charges. I wonder what judge let him out, or gave him low enough bail amount to bond out?

Someone find his docket.

Anyone else guessing that Trudy White may have presided?

it would be aggravated flight

i think escape requires the LEO to have custody of you, like breaking out of prison

this is almost assuredly why the charges are manslaughter. go for the guaranteed conviction

Judge Trudy White set Hilton's bail at $57,500 Thursday morning, according to court documents. He was then referred to Judge Richard "Chip" Moore about two other pending criminal matters, and therefore is unable to be released on bail.

I'm sure it has probably already been discussed but after reading this just now, I had to post something here.

$57,600 bail for running from the cops and KILLING a child?

He was already out on $435,000.00 bail when this happened. Glad to see White is making sure he stays locked up.

Because fleeing from the cops DEFINITELY doesn't indicate a flight risk........ How that useless bitch is still a judge is both baffling and infuriating.

Now we just have to hope that Judge Moore remands without bail.
