"Ford -- was cutting branches off one of their trees. He initially brushed it off, but his wife reportedly came back a short time later and said their fence gate was open and that the neighbor was on their property."
OP didn't post this part. Certainly not worth shooting a guy over, but will be interesting to hear the actual final details.

Do people even think anymore? How insane does one have to be to voluntarily go to prison for the rest of your life so that you can protect a tree branch, so that you can admire the beauty of it. But you &%#* can't because you are going to prison!!!

I was going to post something similar. The Old man at least claims the below as well
quote:
Druzolowski told deputies he got his 357 Magnum revolver out of his nightstand and walked outside to the porch to confront his neighbor about being on their property. He reportedly told his neighbor to get off his property to which Ford reportedly told him to "mind your business."
He then pointed the gun at his neighbor and threatened to shoot him. Ford reportedly walked towards him and did not stop.
"Get off my property right now," he reportedly told Ford, according to the report.
"Stop right now or I'll shoot," he said.
Druzolowski told deputies that his gun holds six rounds and that he usually keeps the first to empty. He pulled the trigger once, but Ford reportedly kept walking towards him so he fired again, according to the report. Ford was hit in the chest, he thought, the report said.
He then told his wife to call 911.

Yea reading more details today. Very odd. The guy that got killed should have taken him seriously when he started pulling the trigger. I also read that the guy who got shot's Mom was the homeowner and she claimed that her fence is inset 2 feet into her property so the guy was on his own property, not the shooters. Bet that old man's wife wishes she hadn't bitched about the neighbor cutting limbs now.

Yet another reason I'll never have any "neighbors" close to me.

The victim's last words, "what are you going to do, shoot me?"

Old people get irrational over plants. My fiancée's mother keeps complaining about her neighbor's oak tree, thinks she can demand the neighbor remove the tree because it's dropping leaves, small branches on her property or if the tree fell it could hit her house. Threatened to poison the tree until I told her she could be sued for damages plus the cost of replacing the tree.

How is this 2nd degree murder and not 1st degree murder?
He threatened to shoot him then shot him, is that not pre-meditated?
I'm not a lawyer, but I always interpreted it this way: premeditated requires the planning and intent in a state of mind that is not caused by immediate rage. Whereas in this case, there was immediate inspired rage that caused him to locate his weapon and use it. I could be wrong, but that's my two cents.

Try that in a small town...

It's unspoken word. Don't frick with an old man's fence.

quote:Appraisal district images aren't always accurate, but they do suggest that the shooter's fence encroaches far into the victim family property.
I also read that the guy who got shot's Mom was the homeowner and she claimed that her fence is inset 2 feet into her property so the guy was on his own property, not the shooters.
So the shooter may have killed a guy who was not trespassing.

Though there seems to be a fence line on the other side that is off by the same amount.
