re: Field sobriety tests aren't designed for you to pass.

Assume I have had 2 or 3 and am unsure if I'm .081 or .079. If you deny the tests, do you lose your license for a year regardless? Or can an attorney get you out of that part?

In my county in TX, breathalyzers are ONLY administered at the county jail, not by the field officer and refusing the tests gets your license suspended for 6 months

Laws probably vary by state. You may be automatically suspended for refusing. However, if you want a chance of beating a dui, refusal is all you can do. Hope your lawyer can get it thrown out or reduced.

Pretty sure you’re losing your license if you refuse.

Don't drink and drive, no problem passing sobriety test

Have you ever had a drink at a restaurant then drive home?

Now this is how you handle FSTs.

No one should ever submit to a SFST. No one. Ever. I mean that literally.
In WI, and I'm sure other states, refusal is an automatic loss of license.

How in the holy hell is he NOT in jail? 8??? That’s insane

I don't get how they can even hold up to scrutiny in court.
It’s funny how every other objective test requires you to have a baseline for valid comparison……except FSTs.

That is the secondary thing that’s bullshite: completely separate from the DUI charge, you get administrative revocation of your license. Essentially If you refuse the “voluntary” tests you lose your license for 3 months to a year.
Even if you are never formally charged, or if the charges are dismissed.

Anyone know if you get arrested for dwi and turns out you’re sober, could u sue the county/police dept?

SFST != breath chemical test. I’m not aware of a single state that has any penalty whatsoever for refusing SFST.

They always position the citizen facing the flashing police strobe light while the cop gets to have his back to the disorienting eye pollution.

Get pulled over for suspected DUI frequently do you?

I assume that they’re going to breathalyze if you refuse SFST? So what’s the point of an SFST? To further build a case against you?
