“The statement implied the house might have been searched and a gun found had Stubblefield not been Black, and that Stubblefield therefore gained an undeserved advantage at trial because he was a Black man,” court documents stated.
The court determined that the conviction was “legally invalid” due to the Racial Justice Act. The Santa Clara County District Attorney’s Office can now decide whether to re-prosecute the case.

Beautiful. He got an unfair advantage when they didn’t search his house because he’s black, and now he gets a rape conviction overturned because he’s black.

So the rape happened in 2015, so I’m assuming the investigation happened shortly thereafter after or before 2020 when he was convicted. So explain the following….

How the frick does this have any bearing on the case? The trial took place shortly after the George Floyd debacle. Why would you be searching a home 5 years after the crime, within weeks of the trial? At that point everything is in place for the trail. The defense has had all the access to the evidence and time to prepare a defense.
This might be the single biggest retarded reasoning for overturning a conviction I’ve ever seen. A judge literally bought “the conviction was racially biased your honor because the prosecution didn’t execute a search warrant 5 years after the alleged incident and weeks before trial” defense.

Maybe searching his house might have yielded evidence favorable to him? Which doesn’t make sense bc his lawyer could have brought forward any such info.

They never searched the home to begin with. The woman claimed Stubblefield raped her at gunpoint. Searching the house for the gun should have been done but they never did that for whatever reason. Then during the rape trial they said they never searched for the gun because they didn't want to appear racist (which is nonsense). They should have just said they had a positive rape kit and a credible witness that came forward right after it happened so they didn't think they needed the gun which probably would have been stashed or disposed of by then anyway.
Appellate Courts don't like to substitute their opinion for a jury but they probably didn't like the failure to search for the gun and hung their reasoning on racial justice nonsense.

In the American progressive religion, racism - the definition of which changes at a whim - is the worst sin imaginable. It’s worse than rape, murder, etc. which is reflected in cases like these.

I’m like did I read this right? He got an unfair advantage b/c he’s a celebrity and black. Got convicted anyway with the advantage.
