Evicting a renter

So my sister owns a place and rents out a room. Agreement for renter to leave in 45 days over text. 35 days pass and renter has 400 excuses why they cannot meet the deadline. There was no original lease agreement.

From what I'm used to seeing, you show up and bring up the issue in person. Inevitably it turns into her offering you sex. Then out of nowhere the paying roommate shows up and joins in the sex.

She's pretty screwed. Tenants have a lot more rights than people realize, and with no original lease agreement it's going to be tough to get rid of them.

5 days notice. give to her in writing or put on her door. go to city court and ask clerk how to file eviction.

It actually doesn’t take a while, IF YOU HAVE A LEASE. I’m not sure why people don’t do this, it protects both parties.
OP, I’ve got no clue how to go about this without a lease. I know Louisiana has a 5 day notice you have to give them. Most leases waive that.
Evictions in EBR take a week or less, generally. Usually I’m just dealing with nonpayment issues.

Even with a formal agreement, an eviction that is fought can take months to execute.

Actually, with no written agreement, that person is a trespasser if your sister is willing to say that and stick to her story.

If they know how, you can fight an eviction and get 28 days before you are removed.

I guess I’ve just been lucky enough to have very stupid people to put out. They try to fight but don’t get anywhere.

I've watched enough LivePD to know that even if crimes are being committed, once the lessee is in the domicile, owner can't just force them to leave. And police/sheriff's deputies will TRY to get one party to leave the domicile for the night, but will not back up an owner trying to remove a lessee.
They'll always tell them "If you really want to evict them, you have to go through the court....this is their home, too."
