I've dealt with it.
I had six page lawyer drafted leases. The renters don't read, so I had them sign away their rights to fight a lawful eviction.
This was after the tenants from hell. Who bred cats and sublessed the house. Went there one day and some random people where there, I asked for tenants. They had moved out. These new guys were paying rent.
They had nothing in the house but a mattress.
I had two cop friends come over in uniform and help throw the stuff out.
Changed all the locks and spent two months renovating. The people tossed were "Travelers".
The house was a decent house, but after this, hired a property manger.
Well manager was a crack head and rented house to his dealer.
The other side to a bus driver(who parked a beat up school bus on side the house) with three pitt bulls.
My neighbors would call complaining constantly.
After that group left, I sold the house. (Green bay packers colored house on Acadian near Government)

If there's no lease agreement, I am not sure how you evict someone. Throw their shite onto the road and change the locks and move on.

The agreement is to pay a set amount month to month. It's not that there was no agreement, there was no signed document.

Personally I wouldn't care if it was verbal. There's no proof, right? Send them packing. Sorry but even if it's a friend, they need to realize you aren't a fricking bank giving out loans.

Courts can rule there is an oral lease on a month-to-month basis.
Find out in the state property code what the default rules are for giving notice (in terms of days and how notice must be given). STRICTLY FOLLOW THOSE RULES (or you may be SOL). If the tenant doesn't move by then, start eviction proceedings. AGAIN STRICTLY FOLLOW THE PROCEDURE.
I used to own rental property and I know the mess it can be to toss someone.

This is a prime reason that after my parents passed on, we chose to sell the house instead of rent. It just wasn't worth the aggravation to us.

If they know their rights, this is a very bad idea. Once someone is in the home, you have to go through a proper eviction.

You need to honestly make your sister clean up her own mess and it help her. Tell her to call a lawyer and get professional help, she was lazy and got into a mess she needs to pay to get out of it.

I'd take my chances on a dead beat renter coming up with enough sense and money to pay a lawyer and sue me without any lease, than to get pushed around in my own house.

Why does your sister have to have the person leave? If she is moving out or something that's one thing, but if it's for some lame reason like she wants her boyfriend to move in after Christmas then let her deal with it the legal way.
