1) read you contract
2) have a professional (contract attorney) read the contract and give you legal advice

3) use information you have been given to make the decision


Depending on contract, you may owe all profit if contract is broken. You may need to meet some of the default clauses in the contract that all breakage without penalties

Yea, not to scare the OP, but he needs to get some legal support asap. In most states, a mechanics lien is one of the most powerful legal instruments there is. He should’ve gotten lien release waivers with each payment, but now that he hasn’t he’s major exposed.

I truly mean no disrespect with this comment.

There are displays of poor judgement. And then there are truly epic stupid decisions.

Giving money to a contractor to build a house with no signed contract involved… that there is NOT a display of poor judgment.

Your sub can get a mechanics lien on your house and can take you to court or just sit on the lien and collect interest till you sell the property.

Had this problem about 20 years ago. Hope you had a written contract and have all your cancelled checks with what the check was for specifically spelled out on each check and even more detail on your check stubs.

I'm still not sure 100% that I understand what's going on with this situation.

Sounds like you hired a guy to do a job. That guy said he wasn't going to do it but he would hire a guy to do it for him.

You paid first guy, first guy never paid second guy or didn't pay him the agreed upon amount.

I see nothing wrong with offering the second guy the remaining amount to finish the job. His beef 'should be' with the guy who wasn't paying him the agreed upon amount.

Be prepared for him to decline. If you can accept that, great. If not, be prepared to make up the difference between what he was promised vs. what he was paid.

Yeah, that’s basically it. The contact guy was supposed to be the guy that pays the worker set amount. He wasn’t, and that guy wanted x amount to do the job. So the contact wanted to squeeze more money out of me without sacrificing what I had paid him. He wasn’t honest with the worker and we caught on to the issue. Worker was quitting the contact regardless so he agreed to just work for himself for what was needed to finish job. Contact was quoted what original bid was and agreed to it but wanted extra money later in job. I was not going to hire worker behind contacts back but he told me he quit so I just want job done and don’t care who does it for amount I allocated to that part of house build.
Bottom line is I was being used for more money for a job I signed no contract on. My fault. Payments were kept track of on checks and contact knew what was left on job but knew remaining balance would only be paid upon completion. Job was not completed so I didn’t pay remaining balance because no work was done since last payment. Worker agreed to finish job working for himself now.

You should pay the person doing the work directly.

Get receipts for materials used on your job and don’t pay him until work is completed.

That’s what we agreed upon. Guy was grossly underpaid by contact. He was pissed about it and I could see why. Contact told worker in front of me that he was making all the money and he was keeping none but that wasn’t the case. We were both screwed over.
