Have a house being built. First contractor couldn’t do it but found someone to do it for the price that I agreed to with him. This contractor finds someone else to do the job. Tells me he won’t make a dime on it and is paying the guy everything. I find out tonight contractor hasn’t been paying his guy the money promised. In return guy doing job is leaving if not paid more. Contractor tried getting more money but I wasn’t budging.
Is it wrong if I get his guy to finish job, but pay him directly since he hasn’t been paid what was promised? Contractor made the money that was kept from worker. Worker said he wasn’t working for him anymore after today.

your contract is with the contractor so yes you can but he may sue and you have to prove everything in court

eta: unless the contract is with first contractor who is not doing the job

or you are in Alabama backwoods and have no contract

The subcontractor told you he's not getting paid? Can that actually be verified? I'd consider cutting ties with both and let them sort it out. You paid what you agreed to.

This is where you messed up. Not sure how you’d let this slide on a home, but to each their own.

Also, he’s lying. He was/is definitely making money. Contractors have a combined IQ of 5

No contract was signed and contractor agreed upon price. Already have extra money that was not agreed upon and wanted more. Person doing the job was promised x amount of money so contractor tried to get it out of me instead of being honest with me. I feel that since I was lied to that it was wrong on his end to begin with. I came out of pocket more than what was agreed upon.

File a claim against the contractors insurance. If he doesn't have insurance file a lawsuit against the contractors.

First talk to a contracts lawyer.

Eta: with no contract signed you're likely to be on the hook for a half finished house with whatever money you didn't pay the contractor. Hopefully you didn't pay him a lot upfront.
