Well had everyone exercised some personal responsibility we possibly wouldn’t be here

Had she not drank so much
Had door guys/Reggie’s employees/bartenders done a better job of monitoring
Had the four accused not chosen to be criminals

My heart breaks for her family and I think if this was my child I’d be beyond devastated and also beyond angry all the way around.

I don't understand WTF Haley is saying. Haley is all over the place. He claims the video does not show a sex act being performed, however he states that the sex was consensual.

To think he is going to present that nonsensical drivel to a grand jury

Make up your fricking mind Haley. Oh yeah, and frick you Ron Haley if you are reading this.

Haley agrees the video shows Brooks to be highly intoxicated in the final minutes of her life. 'She looks pretty drunk,' he said.

At what point does the defense attorney realize that he is killing his case every time he opens his mouth?

Does the person committing the act have a defense if he too is incompacitated and therefore is not able to know or should know the victim was unable to give consent?

Doubtful under Louisiana law. I can almost still here Cheney Joseph's voice as I read La. Rev Stat. 14:15, quoted below:

quote:

§15. Intoxication

The fact of an intoxicated or drugged condition of the offender at the time of the commission of the crime is immaterial, except as follows:

(1) Where the production of the intoxicated or drugged condition has been involuntary, and the circumstances indicate this condition is the direct cause of the commission of the crime, the offender is exempt from criminal responsibility.

(2) Where the circumstances indicate that an intoxicated or drugged condition has precluded the presence of a specific criminal intent or of special knowledge required in a particular crime, this fact constitutes a defense to a prosecution for that crime

Maybe if he was as drunk as she was, he would lack the "special knowledge" of her lack of consent. But if he was that drunk, he'd have WD and probably could not rape anybody.

This reminds me of the opening episode of Better Call Saul when he has yo defend the deranged teens that broke into a morgue and decapitated a dead body for fun.

His opening speech was basically “I mean, WHO among us?”

I’m predicting this shmuck will do the same stuff

I don’t want to derail this thread but is it worthy of a link or new thread for those of us who don’t know?

In my own view, he would do well to learn the rule of holes. When you are in one, stop digging.

The "personal responsibility"

I'm actually okay with this argument.

The victim showed poor personal responsibility, and she was vaginally and anally raped, then left to die as punishment.

Casen Carver showed poor personal responsibility in both his choice of friends and his culpability in a savage rape. It's good that he turned himself and his friends in, but if rape and death is an appropriate consequence for the victim's poor choice, then Carver's consequence has to be more severe. Maybe what.....3rd degree burns over most of his body then crushed by a car dropped from 50 feet overhead? That sounds reasonable to me.

Everett Lee showed poor personal responsibility by filming the rape and contributing to the delinquency of 3 teenagers.
If rape and death is an appropriate consequence for the victim's poor choice, then Lee's must be more severe. Let's go with filming him having his legs eaten off by some hungry pigs, then a quick lynching.

Kaivon Washington showed poor personal responsibility by raping the victim and pushing her out of a car, and allegedly, he's raped before. If rape and death is an appropriate consequence for the victim's poor choice, then Washington's must be MUCH more severe, given his past crimes. Have his genitalia flayed then rectally impale him while being lynched.

The minor showed poor personal responsibility by raping the victim, but he's a minor, and can't be held responsible for his choice, so we have to execute his parent(s) or guardian.

All seems fair to me.

I'm about 20 pages behind since this thread suddenly started moving quickly again this afternoon, but...

Laws are not morality. There's nothing wrong with 18+ drinking. Pretending the age is the issue is pure idiocy by Tate, not that it's surprising.

The majority of people in Louisiana were likely legal at 18 before the laws were changed. A large percentage of the world is 18 or less, if not a majority.

Getting blackout drunk is obviously bad, but age has nothing to do with it. This is a huge waste of resources and time.

How about Sixth and Barone posting false information about the victim? He made up all that inflammatory stuff before deleting it

When he said the video will paint the rapists in a better light?

I take it he was not talking about the one where the Judge said it looked like a crime and got the prosecution to seek a more harsh indictment?

He then drove to a nearby street and 'stated he overheard his 17-year-old friend as he asked the victim five times if she wanted to have sex with him,' continued the report. 'Mr. Carver stated the victim gave verbal consent.'

Just to be clear, legally, she was too drunk to give consent right? This has been my assumption, I just want to make sure I am correct.

Also, this doesn't play a factor in anything, by why was a 28 year old hanging out with 2 18 year olds and a 17 year old?
