Court rules Houston man must pay $65k in child support for kid that's not his

A Texas court has ruled that a Houston man who is not the father must pay $65,000 in child support to the mother of a teenage girl he's only met once.
Gabriel Cornejo, of Cypress, Texas, a father-of-three who is also raising two of his brother's children, says he only found out his ex claimed he was the father of her 16-year-old girl, last year.
But even after a paternity test proved he wasn't the father, Cornejo is still being held liable for unpaid child support because a court says he did not contest the paternity suit when his former girlfriend first submitted it in 2003.
Cornejo, originally from Panama, insists he was never notified about his ex's claims at the time and is hoping to overturn the ruling when the case goes to court next month.
quote:
'They say he should have fought back then and he failed to do so,' his lawyer Cheryl Coleman said. 'But how can you fight something you don't know anything about?'
If he fails to pay, he could land in jail.
'Don't stick your head in the sand,' the girl's mother's lawyer said. 'It won't go away and there can be consequences even if you don't do anything.'
This is why it should be a law that in order to put the name of the father on a child's birth certificate, a DNA test is mandatory

Which equates to exactly $65,000 more than my former brother in law has paid in child support since his divorce from my SIL 3 years ago.

I don't even like the idea of raising a kid that's mine.
frick raising a kid that's someone else's.

This is why women shouldn't be allowed to vote.

Judge should be removed from the bench, be disbarred, and receive a beating or three. Ruin this man like that.

Fight this all the way to Supreme court. I'm sure a mens group could use this as a stepping stone of stopping this shite.
Can we get a name of the Judge? Smells like ur typical Liberal bullshite.
And he isn't the first person that has had to pay, even though it wasn't his.

If someone sues and says you mangled him in a car accident even though you were nowhere around, and you don't file an answer, you get hit with a judgment.
It's no different here. If someone sues you for something, you need to answer. Especially in domestic law, you can go down to the Court and fill out a one page form that says "I dispute this and owe nothing." Simply ignoring it is moronic.
And considering you have to prove service to get a judgment, I'm going out on a limb and saying he's full of shite about not knowing. I'm guessing the $65,000 in arrears didn't appear overnight in the 14 years since the judgment was entered either.

I get the technical nature of the ruling if he didn't respond, but you'd think common sense would prevail and he'd just have to file new documents or whatever and get this reversed.

Did Judge Trudy White move to Texas? Pretty please???

You can file to vacate the default and at least try. Newly discovered evidence is grounds most places, as is lack of service if he really is sticking with that story.
I'm sure child support judgments are modified quite often for subsequent DNA tests.

He needs a Gofundme. If anything for legal cost to fight that shite. That's bullshite.

If you don't answer allegations there are consequences. If he had a lawyer, he can sue the lawyer for malpractice. If he did not have a lawyer, EXPENSIVE lesson learned.

I thought the courts only did shite like this to white guys. Glad to see this country is finally focusing on equality in its courts.
