Started this on the Movie/TV Board but not as many people visit that board.

Last month, a Colorado state jury officially declared that Cinemark, which is the third largest theater chain in America, is not to be held responsible for the fatal Colorado theater shooting carried out by James Holmes in 2012. Now, Cinemark is asking for all of the victims involved with the case to pay legal fees for what happened the night of July 20 nearly four years ago.

The chain is asking for $699,187.13 in legal fees and other costs, sending the bill directly to the nearly 30 plaintiffs in the case, working in consolidated action. The victims and the surviving family members of those killed are now being held responsible for these costs that have accumulated through this ordeal.

State law in Colorado allows the winning side in a civil case to seek redemption for acquired legal costs and court fees. This is true of many states throughout the U.S. Cinemark won their state case on May 19 going up against a 6-person jury. The jury delivered a unanimous verdict that stated the chain was in no way responsible for the massacre, not even partially. Thus far, Cinemark has not responded to requests for comment.

Well the victims certainly aren't responsible.

Well, since they shouldn't have sued...

Cinemark filed all the paperwork last week. The chain is asking for $699,187.13 in legal fees and other costs, sending the bill directly to the nearly 30 plaintiffs in the case, working in consolidated action.

I'm glad they weren't held responsible. But I'm shocked they're trying to recoup lawyers fees. You'd think they wouldn't want the negative publicity.

Mixed feelings on this. I think trying to sue everyone and everything for money due to a tragedy is out of control in this country.
Not sure how a theater is responsible. That said, the victim families have suffered a lot.

Here is loser pays. As if the legal system needed to be slanted more in favor of Big Business.

I fully agree with Cinemark.

They should have never been sued in the first place. This is what happens when you sue everyone just hoping for a bigger settlement. I don't care if that sounds harsh or insensitive.

If you accept that Cinemark wasn't responsible, then why shouldn't they be entitled to getting reimbursed for the legal fees?

They are for the legal fees. Had they not sued, there would be no legal fees. And they had no case.

Unless Colorado is a "loser pays" state (which most US states are not), this is merely a request that I'm sure will get denied.
Kind of crass on the Cinemark attorneys to file that with the victim's families, though. They should have known it would create a PR nightmare.

What happened there is horrible but I don't see how Cinemark is to blame for this. I think those victims got sold a pipe dream by a bunch of hungry lawyers and were led to believe this was their golden ticket. They lost and I don't think Cinemark should be left with a bill that large for proving their innocence.
Maybe rulings like this will stop ambulance chasing people and lawyers for hoping to get rich off of horrible events. They need to also take back every penny the plaintiffs lawyer made from trying that case, if he got paid at all.

If we had more loser pays, our courts wouldn't be as clogged with frivolous bullshite and insurance would be a hell of a lot cheaper

Well, they sued Cinemark with a weak case as a money grab and they lost. I don't blame Cinemark, or any person/corporation in the same situation, for asking to have their legal fees paid by the other party.

N/M
That's the risk of suing and losing.

Exactly.

So each family is on the hook for around 23g's and I bet they were expecting waaaay more than that from Cinemark.. Seems fair.

Exactly, the victims sued Cinemark and lost. That's what happens when you let money hungry lawyers talk you into shite.
