Those people shouldn't have sued Cinemark. They knew the rules going into the lawsuit.
They wanted to play, they lost...they pay. Could have gone the other way and Cinemark would have paid.

They should have never been sued in the first place. This is what happens when you sue everyone just hoping for a bigger settlement. I don't care if that sounds harsh or insensitive.
1. They'll probably not be able to get that much money from those families
2. The negative PR likely won't be worth it.

I don't blame Cinemark, although as a business (not legal) decision, I'm not sure I would have made the same call considering the PR and issues in collection.

They're responsible for shui g the theater for something that isn't their fault.

As I said in the other thread, if anyone should have to eat the cost of this it should be the attorneys who convinced these people to bring the suit.

So recover nothing? Chalk it up as an operating expense because the families decided to sue them for something they had zero control over? At some point people need to stop suing everyone just to get a check. This is an unfortunate start to stopping it, but oh well.

Just to put this out there, plaintiff's attorneys will pay for their side of this and then recover their costs if they get a settlement/judgment.
Sometimes this works really well, sometimes you lose your arse. I believe a recent example was the FEMA trailer cases in LA. Some P lawyers really fricked themselves on that one.

No offense but Cinemark has insurers who absorbed their legal fees. This is nothing more than the insurance companies trying to make some money off the victims families.
