It's pretty simple, if they decide to take further legal action, then you countersue for legal fees. I disagree that this is the correct course of action. 700K is not worth the negative implications this will have on them due bad publicity. Most courts would not entertain another lawsuit, hence the deterrent angle isn't sufficient to make this call IMO.

It just seems like a dumb move. Let's say 150,000 people catch wind of this and decide they won't see a movie at any of their theaters for a year. Assuming that 150k sees at least 3 movies a year and assuming a 20% cut by the theater, that's roughly $10 x 450000 x .20 = $900,000. That's without adding in the potential cost benefit of writing off legal fees on taxes or taking into consideration that not all of the victims will pay if the judgement is granted.

Lets not fool ourselves. The whole point of "loser pays" tort reform is to punish those who try to sue corporations and to discourage even potentially legitimate lawsuits from even happening.
"you have a 50% chance of winning, but if you lose we will bankrupt you and your family."
A lot of people will opt out of that.
