But to play devil's advocate, it allows a big business to an incredibly expressive legal team, which a standard person cannot. I agree with the premise but feel like there should be some kind of cap.

you bill the victims and not the shooter?
I guess the surviving victims have a better opportunity to work and make money to pay those bills

Good for them. Get greedy and try to take advantage of the death of a loved one for more $$$. Serves them right. Like money is the cure for a loss of a loved one unless your are a TPOS.

There are mechanisms in place within lawsuits for a judge to dismiss frivolous lawsuits or lawsuits which fail to state a claim upon which relief can be granted.
Loser pays threatens to shut off access to courts for a significant portion of the population.
I know this one is an easy one to rally around because the claims were weak, but this is much bigger than any one case.

They said this in Texas when they pushed for tort reform and guess what? Insurance costs continued to rise at the same rate.

At some point during the litigation one of the plaintiff's attorneys likely said "don't settle for that amount, Cinemark would NEVER put this thing before a jury," to which the plaintiff's listened and now are on the hook for Cinemark's legal fees.

Agreed. A "Loser pays the fees" system sounds good in theory but all it does is present a barrier to entry for the common citizen.
Do you think people in situations like those found in movies like "Erin Brockovitch" and "The Rainmaker" would have been able to seek justice if they thought there was a chance they would be on the hook for $1M+ if they happened to lose? I highly doubt it.
Cinemark chose to spend $700K defending themselves. We all agree Cinemark shouldn't be held responsible and that this was a common sense case. One could argue you didn't need to spend $700K to win in the first place.
Not all court cases are frivolous. All citizens must have the ability to be heard in court even in situations where they take on entities with deeper pockets.

Insurance companies will always raise rates! People complain about rates so they find a BS reason to jack them up. Once one reason is "fixed", they'll find another.

The insurance companies have run a fantastic PR campaign villainizing trial lawyers for why insurance rates are so high. Check out the profits these guys are making on your State's department of insurance website and tell me how bad they really have it.

I don't blame Cinemark one bit. When people file frivolous lawsuits, which this 100% was, they should always be required to pay the legal fees for the other party.

The victims aren't responsible, but they should not have sued the movie theater. If they are only going after victims who sued the movie theater then I don't care. Maybe it will get people to stop suing soft targets after a shooting.
